Ministry of Textiles, through Order S.O. 3916(E) dated 12th September 2024, has introduced the Protective Textiles Quality Control (Upholstered Composites used for Non-Domestic Furniture) Order, 2024. This order mandates the use of Indian Standard (IS) 15768:2008 for upholstered composites used in non-domestic furniture, ensuring conformity to fire resistance standards. While the order applies to materials used in non-domestic furniture, goods meant for export and raw materials such as fabric rolls used in assembly are exempt. Furthermore, manufacturers and importers dealing with non-domestic furniture assembly are exempted from this quality control order until 31st March 2025. The Bureau of Indian Standards (BIS) will oversee certification and enforcement of the standard mark under the Bureau of Indian Standards (Conformity Assessment) Regulations, 2018. The latest versions of the relevant standards, as published by BIS, will apply from their date of publication. This order continues the quality control efforts under the previous amendment order dated 12th September 2024. The regulation aims to enhance safety and compliance within the non-domestic furniture industry.

ORDER
New Delhi, the 12th September, 2024
S.O. 3916(E).—In exercise of the powers conferred by sub-sections (1) and (2) of section 16 read with section 17 and sub-section (3) of section 25 of the Bureau of Indian Standards Act, 2016 (11 of 2016), the Central Government is of the opinion that it is necessary so to do in the public interest and after consulting the Bureau of Indian Standards, hereby makes the following Order, namely:-
1. Short title and commencement.– (1) This Order may be called the Protective Textiles Quality Control (Upholstered Composites used for Non-Domestic Furniture) Order, 2024.
(2) It shall come into force on the date of its publication in the Official Gazette.
2. Application – This Order shall apply to :-
(a) goods or articles specified in column (2) of the Schedule annexed to this Order, but shall not apply to such goods or article meant for export;
(b) upholstered composites or fabric traded as raw material or rolls or used in assembly of non-domestic furniture :
Provided that the industry dealing with the assembly of non – domestic furniture (manufacturing or importing) , wherein upholstered fabric is used as part of the finished furniture product shall be exempted from this Quality Control Order till 31st March 2025.
3. Compulsory use of Standard Mark. – The goods or article specified in column (2) of the said Schedule shall conform to the corresponding Indian Standard specified in column (3) thereof and shall bear the Standard Mark under a licence from the Bureau in accordance with Scheme-I of Schedule-II to the Bureau of Indian Standards (Conformity Assessment) Regulations, 2018.
4. Certification and enforcement authority. – The Bureau shall be the certifying and enforcing authority in respect of the goods or article specified in column (2) of the said Schedule.

Note:
(1) For the purposes of the Schedule, it is clarified that the latest version of Indian Standards established and published by the Bureau from time to time in accordance with the provisions of clause (17) of section 2 of the Bureau of Indian Standards Act, 2016 (11 of 2016), shall apply from the date of such publication.
(2) Definition of “non- domestic furniture” with regards to this Order is to be referred from the standard IS 15768:2008 issued by Bureau of Indian Standards.
(3) For the purpose and scope of this Order, any industry or firms who wish to manufacture or assemble upholstered furniture for domestic purposes shall have to give a Self- Declaration under IS 15768: 2008 that ‘their products are meant for domestic requirements’. This declaration is deemed sufficient for compliance purposes.
This Order issues in continuation to the Protective Textiles (Quality Control) Amendment Order, 2024 published in the Gazette of India, Extraordinary, Part II, Section 3, Sub ± Section (ii), vide notification number S.O. 3896 (E) dated 12th September 2024.
