The petitioners who have filed this public interest litigation (PIL) submits that there is urgency in the matter since more than 50 patients have died on account of mass strike of resident doctors numbering about 4,500 all over the State of Maharashtra.

Learned counsel appearing for the respondent Association submits that they have not given any call for a strike or an advise to go on leave and, according to them, they have made all endeavour to see that their members would not create a situation where the general public who need attendance of the doctors at hospital are to be troubled and suffer hardship. He submits that already there are directions by the Court to be complied with by all the members of the Association i.e. the resident doctors. We make it clear that if any particular member is disobeying the order of the Court or not complying with the request made by the Association, the respective management will be at liberty to take suitable action against them as per the law apart from initiation of contempt proceedings.
