NOTIFICATION
New Delhi, the 20th February, 2020

G.S.R. 132(E).—In exercise of the powers conferred by section 6A read with sub-section (1) of section 7 of the Employees Provident Funds and Miscellaneous Provisions Act, 1952 (19 of 1952), the Central Government hereby makes the following Scheme further to amend the Employees’ Pension Scheme, 1995, namely:-

1. (1) This Scheme may be called the Employees’ Pension (Amendment) Scheme, 2020.

(2) It shall come into effect from the date of its publication in the Official Gazette.

2. In the Employees’ Pension Scheme, 1995, after paragraph 12, the following paragraph shall be inserted, namely:–

“12B. Restoration to normal pension in cases of grant of commutation. – The normal pension in respect of those members who availed the benefit of commutation of pension under the erstwhile paragraph 12A of this Scheme, on or before the 25th day of September, 2008, shall be restored after completion of fifteen years from the date of such commutation.”.

Note : The Employees’ Pension Scheme, 1995 was published in the Gazette of India, Extraordinary, Part II, section 3, sub-section (i) vide notification number G.S.R. 748(E), dated the 16th November, 1995 and was last amended vide notification number G.S.R. 285(E), dated the 4th April, 2019.

    Sir,
    I was on in Ltd co. From 1972 to 1991 I had got lumpsum from EPs fund. Shall I be eligible for some pension under new amended act dated 20/02/2020. Please advice.

      I was superannuated on 30-04-2003. My pay was Rs.16417/- on 30-04-2003. I took commutation benefit. My pension was decided on the basis of pay at Rs.6500/-, which was the maximum permitted. Initially my pension started with Rs.417/- and after 17 years now I am getting only Rs.606/-. I do not know why Rs.6500/- only was considered as my pay.
      What would be my pension on restoration of full pension as per the 26th February order.

    My PPO number is 3000151. I had opted for commuted pension & getting Rs.782/- since last 20 years plus. What shall I do to get full pension as per amendment dated 4th April 2019.

    Please clarify in the following case. An employee has retired on 01-01-2005. His pension worked out to Rs.3000/- pm. He has received 1000*100 = 100000 as 1/3rd commuted value of his pension. He is in receipt of balance pension of Rs.2000/- pm. He has completed 15 years pension on 31-12-2019. Does this amendment means that he will get Rs.3000/- (original pension before commutation) from January 2020. Please inform even if i am wrong.
