Section 142 of the Social Security Code – 2020 Notified

Aadhaar mandatory from 3rd day of May, 2021 under Code on Social Security, 2020 for availing (a) registration as member or beneficiary; or (b) seeking benefit whether in kind, cash or medical sickness benefit or pension,gratuity or maternity benefit or any other benefit or for withdrawal of fund; or (c) availing services of career centre; or (d) receiving any payment or medical attendance as Insured Person himself or for his dependants.

Section 142 of the Social Security Code, 2020 has been notified by Ministry of Labour & Employment covering applicability of Aaadhar.  The notification of section will enable Ministry of Labour and Employment to collect Aaadhar details for the database of beneficiaries under various social security schemes.

Now the monthly ECR shall be allowed to be filed only for those members, whose Aadhar nembers are seeded with respective UAN and verified. It is therefore requested to ensure that the Aadhar is seeded or all contributing members, to enable them to avail uninterrupted services of the EPFO and to avoid any inconvenience in future. All employees may also be made aware of the same and advised to seed their Aadhar directly through the online e-KYC facility available on the member portal and UMANG APP or through the employer immediately.

National Data Base for unorganised workers (NDUW) is at an advanced stage of development by National Informatics Centre.  The portal is aimed at collection of data for unorganised workers including migrant workers for the purpose of giving benefits of the various schemes of the Government.  An inter-state migrant worker can register himself on the portal on the basis of submission of Aaadhar alone.

Union Minister of State (I/c) for Labour and Employment Shri Santosh Gangwar has clarified that the section under the Social Security Code has been notified only for collection of data of workers including migrant workers. No benefit will be denied to workers for want of Aaadhar.

S.O. 1730(E).—In exercise of the powers conferred by sub-section (3) of section 1 of the Code on Social Security, 2020 (36 of 2020) read with section 14 of the General Clauses Act, 1897 (10 of 1897). the Central Government hereby appoints the 3rd day of May, 2021 as the date on which the provisions of section 142 of the said Code shall come into force.

Extract of Section 142 of Code on Social Security 2020

Application of Aadhaar.

142. (1) An employee or unorganised worker or any other person, as the case may be,for—

(a) registration as member or beneficiary; or

(b) seeking benefit whether in kind, cash or medical sickness benefit or pension,gratuity or maternity benefit or any other benefit or for withdrawal of fund; or

(c) availing services of career centre; or

(d) receiving any payment or medical attendance as Insured Person himself or for his dependants,

under this Code or rules, regulations or schemes made or framed thereunder, shall establish his identity or, as the case may be, the identity of his family members or dependants through Aadhaar number and for such purpose the expression “Aadhaar” shall have the meaning as defined in clause (a) of section 2 of the Aadhaar (The Targeted Delivery of Financial and Other Subsidies, Benefits and Services) Act, 2016:

Provided that any foreigner employee shall obtain and submit Aadhaar number for establishing his identity, as soon as possible, on becoming resident within the meaning of clause (v) of section 2 of the Aadhaar (Targeted Delivery of Financial and Other Subsidies,Benefits and Services) Act, 2016.

(2) For the purposes of sub-section (1), the Aadhaar number issued to an individual shall be in accordance with the provisions of section 3 of the Aadhaar (Targeted Delivery of Financial and Other Subsidies, Benefits and Services) Act, 2016.
