The new system of import from registered sources will come into effect from 1st April, 2006. However, in cases where Bill of Lading is dated 1st August, 2006 and before,imports will be allowed on the basis of Pre-Shipment Inspection regime in terms of Para 2.32 of the Handbook of Procedures (Vol.1), notified vide Public Notice No. 1 dated 8th April, 2005 and as amended from time to time.
In exercise of powers conferred under Paragraph 2.4 of the Foreign Trade Policy 2004-2009, the Director General of Foreign Trade hereby makes the following amendments in Handbook of Procedures.
In the statement of Standard Input Output Norms as contained in the Handbook of Procedures, (Vol.2) 2004-2009, as amended, amendments/ deletions/ corrections/ additions at appropriate places as mentioned in Annexure “A” to this Public Notice are made.
To facilitate clearance of second hand capital goods under free category, a declaration by the importer at the time of clearance that the capital goods imported are second hand capital goods and do not fall under the category of remanufactured capital goods may be accepted by the customs authorities.
In case of third party exports in case of DEPB claims based on EDI DEPB shipping bills, the applications will also need to be filed through the ECOM mode only on the DGFT website and no manual DEPB applications will be allowed. Regional Licensing Authority will however need to check on the admissibility of the third party claims from the documents submitted by the third party claimants in this behalf before passing such claims.
An additional quantity of 781 MTs of white sugar against short delivery of preferential EU quota in 2004-2005 is allocated for export to EU for the period from October 1, 2005 to September 30, 2006. This enhances the preferential quota of white sugar from 10,000 MTs to 10,781 MTs.
The matter has been examined by the Ministry of Environment & Forests who have clarified that as per rule 12 of the Ozone Depleting Substances (Regulation and Control) Rules, 2000, importers of ompressors have to be registered with the competent authority for import of Compressors using Ozone Depleting Substances. Registration requirement will not be applicable for importing Compressors using non-Ozone Depleting Substances.
Import of products, equipments containing Ozone Depleting Substances (ODS) will be subject to Rule 10 of the Ozone Depleting Substances Rules, 2000. In terms of this Rule no person shall import or cause to import any product specified in Column (2) of Schedule VII which was made with or contain Ozone Depleting Substances specified in Column (3), unless he obtains a license issued by the Directorate General of Foreign Trade.
In exercise of powers conferred by Section 5 of the Foreign Trade (Development & Regulation) Act,1992 (No.22 of 1992) read with paragraph 1.2 of the Foreign Trade Policy, 2004-2009, the Central Government hereby notifies the Foreign Trade Policy, 2004-2009 incorporating the Annual Supplement as updated on 7th April 2006 and contained in Annexure to this notification. The policy shall come into force w.e.f. 1st April 2006.
