This Notification No. amends Notification No. 8/99-Customs, dated the 22nd January, 1999

Notification No. 68/2000-Customs

In exercise of the powers conferred by sub-section (1) of section 9A of the Customs Tariff Act, 1975 (51 of 1975) read with rules”18 and 20 of the Customs Tariff (Identification, Assessment and Collection of Anti-dumping Duty on Dumped Articles and for Determination of Injury) Rules, 1995, and to give effect to the Order passed by the Customs, Excise and Gold (Control) Appellate Tribunal, New Delhi, dated the 7th February, 2000, in M/s. Oswal Woollen Mills Ltd. vs. The Designated Authority (Anti-Dumping Division), Ministry of Commerce, Government of India, New Delhi (Appeal No. C/73/99-AD with C/Stay/186/99-AD), the Central Government hereby makes the following amendment in the notification of the Government of India in the Ministry of Finance (Department of Revenue), No. 8/99-Customs, dated the 22nd January, 1999, namely:-

In the said notification, –

(i) for the TABLE, the following shall be substituted, namely:-

(ii) the Explanation shall be re-numbered as Explanation I and after the Explanation I as so re-numbered, the following shall be inserted, namely:-

“Explanation II.- For the purposes of this notification, the rate of exchange for conversion of US $ into Indian rupees for levy of the anti-dumping duty shall be the rate of exchange determined by the Central Government in terms of clause (a) of sub-section (3) of section 14 of the Customs Act, 1962 (52 of 1962), as in force on the date on which the relevant bill of entry is presented under section 46 of the said Customs Act.”.
