Two queries are coming every day in and day out under LBT- A. Whether the turnover of sale made from the city to outside the city is covered or not, specifically in view of clarification dt. 15-9-2015? B. Whether the tax paid under amnesty is subject to interest and penalty again when the turnover on assessment is found more than declared under the amnesty scheme? My views on the same are as follows-
Every Local Body Tax (LBT) Practitioner is facing daily disputes with Corporation Authorities for levy of LBT qua goods or qua dealer due to misunderstanding of relevant sections under, The Maharashtra Municipal Corporation Act. The relevant sections for dispute in relation to ‘goods’ are section 127(2), 152B and 152P of the Act.
In the case of Sodexo SVC India Private Limited. Vs The State of Maharashtra and Others, Bombay High Court has held that Sodexo meal vouchers are utility goods- Octroi & LBT can be levied on the same. Sodexo has preferred an appeal against the verdict in Supreme Court

In order to settle at rest confusion regarding meaning of Turnover for eligibility under LBT exemption, now a clarification has been issued by Urban Development Department (UDD) vide Notification No. LBT. 2015 / C.R. 42 / UD-32 dated 15 September 2015 in Maharashtra. The UDD has stated that the turnover of the dealer within the municipal corporation area is required to be considered.
