Reg: Request for extension of date for filing Income Tax Returns for AY 2017-18 in cases where Tax Audit Report or Transfer Pricing Report or other Audit Report are prescribed
All India Federation of Tax Practitioners having its registered office at Mumbai, is an Apex Professional Organization, comprising of Advocates, Chartered Accountants and Tax Practitioners, serving the society for the past 04 decades. The main object of the Federation is to disseminate the knowledge and to resolve the problem being faced by the professionals.
At the outset, we place our heartfelt gratitude for extending the due date of filing of income tax returns in cases where various audit tax reports are prescribed, till 31st Oct 2017.
However we are getting several requests from our members all over India that this year, being the extra ordinary year, it is very difficult to file the income tax returns on or before 31st Oct 2017 due to exceptional circumstances.
Your Honor are well aware that this year, professionals are busy in making compliance with GST obligations. GST Act is new, compliances are many, notifications are being issued everyday and the technical glitches in the system have aggravated the problems. Further dates are being extended everyday and the professionals have to make the compliances on daily basis. Accordingly, professionals are finding a very short time for making compliance with the income tax obligations.
(2) Apart from this, CBDT has notified new Income Computation and disclosure standards with effect from 01.04.2016 which has increased the complications and has required more time to spend by the professional in finalizing the tax audit reports.
Further this year, October is a month which is having number of festivals e.g. Durga Puja, Lakshmi Puja, Vishwakarma Puja, Deepawali and Chhat Puja.
This is not all. CA examination have been scheduled to take place from 01st Nov 2017 and most of the articled clerks and assistants are on leave in the offices of the Chartered Accountants.
Companies Act 2013 has also made certain changes requiring various details to be incorporated by the auditors in their audit reports which is time consuming.
Under these circumstances, we request Your Honour to kindly consider further extension of date for filing the income tax returns at least for a month i.e. upto 30th Nov 2017 in cases where tax audit report or transfer pricing report or other audit reports are prescribed.

No point in commenting in this web site. Auditors and Consultants have lost their hope. Nothing is been done and no Progress. No response from the CBDT and even they least bother to announce that, Extension may not be possible. simple you have announced 89% Tax payers/Auditors/consultants
are expecting extension. all bogus. further don’t open this column for comment on this matter. simply waste of time.

sir that much whole country is requesting but still they not considering our request just thinking any value for professional is there or not. dear friends please help in this regards that i know due to my health i not going to file about 50 to 60 audits within due date , suppose if not if 271b initiated what to do to drop please advice in this regards so that i can take some rest on my health ground since due to sleepness i got fever shivering becuase of tension please. they became deaf ears for this much request that too from whole country

It is indeed necessary that the due date be extended by atleast one month. There are so many compliance to be made , assessments to face , surveys are going on , Service Tax and VAT departments are issuing notices for so old periods , even Income Tax Dept is issuing notices for old demands , for prosecutions etc etc . It is very horrible situation even though we try to equip ourselves and try to keep pace with that of all the departments . For defaults / lacuna by the Departments , nobody is responsible but for defaults by the assessees or their consultants , they are punished by heavy penalties . I believe all consultants are working day and night to achieve the due dates but after all there are limitations , we just cannot order the staff and the clients to do some thing , we have to monitor the same as attesting authority. Government should understand this and extend the due dates as it has extended earlier when there were problems in GST Portal .

The Hon’FM and the CBDT and the Revenue secretary Knows the problems being faced by the Professionals and the Business people. It would be appreciated if they extend the due date, at least on receipt of this representation.

The request of AIFTF is valid and justified. There are so many occasions made in our country. And also stated that the assesse /Chartered Accountants/Advocates/Tax Practitioners all are suffering havok pressure on filing of VAT Return (Revised), GST works was taken so many times. So, sir I further request to extension of date of filing the Audit/Income Tax Return for the assessment year. 2017-18 till Nov/Dec, 2017.

The request made by AIFTF is valid in view of erratic behavior of ITD and NSDL portals. Similar requests need to be made for GST and ETDS portals managed by NSDL. Latest upload of e-GOV sevices have made eTDS portal more fragile, firstly there is problem with CAPTCHA service and then if login is managed 2nd eTDS window is not available!
GST Portal, if logged in, does not make RETURN Window is not available.
