Excise and Taxation Department Vs Allied Strips Ltd. & Anr. (NCLAT)
This case has been called out after a pass over but no one has put in appearance on behalf of the Appellant. It seems that the Appellant is not interested in pursuing this appeal though a claim has been set up of an amount of Rs. 62,87,97,078 pertaining to the assessment year 2014 to 15.
Not only that the present appeal has been filed alongwith application bearing I.A. No. 4281/2019, in which prayer has been made for condonation of delay of 147 days but there is no representation on behalf of the Appellant.
Though this appeal is pertaining to the Department of Excise and Taxation, Govt. of Haryana and the amount involved is in Crores but the attitude of the Appellant is totally casual in pursuing this litigation. Thus, keeping in view the aforesaid facts and circumstances, there is no alternative with us but to dismiss the appeal for non-prosecution.
At the time of parting with the order, we would hasten to add that this order is required to be brought to the notice of the Secretary of the Department of Excise and Taxation, who would take appropriate steps against the officers involved, who are not pursuing this appeal diligently as it should have been.
