Allahabad High Court granted bail to applicant involved in criminal matter based on the principle of ‘bail is a rule and jail is an exception’ and also concluding that there are no chance of absconding.

Facts- This Criminal Misc. Bail Application u/s. 439 Code of Criminal Procedure,1973 has been filed by the applicant- Padam Singhee with a prayer to allow the present bail application and direct to release the applicant on bail in Enforcement Case Information Report under the Prevention of Money Laundering Act, 2002 lodged by the Directorate of Enforcement on 26.03.2021.

Conclusion- Held that the principle of “bail is a rule and jail is an exception” is being consistently followed and repeatedly being reiterated and reminded by the Apex Court and other Courts. The applicant is in jail since 07.02.2024. There are no chances of his absconding. Looking to the facts and circumstances of the case, it is a fit case for grant of bail. Thus, held that let the applicant- Padam Singhee, be released on bail in the aforesaid case crime number on furnishing a personal bond and two sureties each in the like amount to the satisfaction of the court.
