This issue was considered in detail in consultation with Deptt. of Revenue. It was felt that, when the duty paid material is provided by DTA Unit to EOU in terms of Ministry of Finance instructions as stated above, then this duty paid should be refunded back. Accordingly, in respect of such direct exports from EOU based on the duty paid material supplied by the DTA units for job work, duty paid on the inputs would be refunded back by way of Brand Rate of Duty Drawback.
The follwing entry shall be added as S. No.38 in the Schedule 2 Appendix I of the Book titled ” ITC(HS) Classification of Export and Import Items 1997-2002.
In exercise of the powers conferred under Paragraph 4.11 Of the Export & Import Policy 1997-2002, the Director General of Foreign Trade hereby makes the following amendments in Schedule 2 Appendix I of the Book Titled ” ITC (HS) Classification of Export & Import Items 1997-2002.
In exercise of the powers conferred under Section 5 of the Foreign Trade Development & Regulation Act, 1992 (No. 22 of 1992) read with Paragraph 1.3 of the Export and Import Policy, 1997-2002 (incorporating amendments made upto 13.4.1998), the Central Government hereby makes the following amendments in the Export and Import Policy, 1997-2002, (incorporating amendment made upto 13.4.1998).
Handbook of Procedures, 1997-2002 Vol. 2 ( incorporating amendments made upto 31st August, 1998. Attention is invited to the Export and Import Policy, 1997-2002 (incorporating amendments upto 13th April, 1998) published under the Ministry of Commerce Notification No. 1 (RE-98) dated 13.4.1998.
– In exercise of the powers conferred by Section 5 of the Foreign Trade (Development and Regulation) Act, 1992 (No. 22 of 1992) read with Paragraph 4.1 of Export and Import Policy, 1997 –2002, as amended; the Central Government hereby notifies the ITC(HS) Classifications of Export and Import Items 1997-2002 (Revised Edition: August, 1998) as contained in Annexure to this Notification.
It is hereby clarified that the items which are canalised can be imported by Canalising Agency only and not by an individual importer. An individual importer shall require an Import licence issued under Paragraph 4.8 of the Export and Import Policy (1997-2002) as amended.
In exercise of powers conferred under Paragraph 4.11 of the Export and Import Policy, 1997-2002, the Director General of Foreign Trade hereby makes following amendment in Chapter IV of the Handbook of Procedures, 1997-2002, Vol. 1 ( incorporating amendments made upto l3th April, 1998 ).
The Licensing Authority may grant extension in export obligation period for a period of four months against one or more consignment/sight on payment of penalty of 1% on the unfulfilled fob value of export obligation with reference to cif value of the imports made for which extension is being sought. Any request for extension beyond a period of four months can be considered only by a Committee headed by Director General of Foreign Trade.
In exercise of powers conferred under paragraph 4.11 of the Export and Import Policy, 1997-2002, as notified in the Gazette of India extraordinary, Part-II- Section 3 – Sub- section (ii) vide S.O No. 283(E) dated 31.3.97, the Director General of Foreign Trade hereby makes following amendment in the Handbook of Procedures (Vol.1) (RE-98), 1997-2002.
