M/s Gangavaram Port Ltd. (GPL) had been approved as a Customs Area for unloading imported goods and loading export goods in specific berths through previous office notifications. The present notification amends the existing notification from 2015 to include Berth No.: 9 as a proper place for unloading and loading activities.

The amendment is made under the powers conferred by Section 8(a) of the Customs Act, 1962, in response to the request made by M/s Gangavaram Port Ltd. The amendment enables the handling of imported goods, export goods, empty containers, and containerized goods at Berth No.: 9 of Gangavaram Port.

This expansion of the customs area at Gangavaram Port is expected to facilitate smoother import and export operations, providing additional capacity for unloading and loading activities. It aligns with the objective of enhancing trade facilitation and improving logistics infrastructure.

Conclusion: The Ministry of Finance’s Notification No. 01/2022 (Customs) (NT) (VSP) designates Berth No.: 9 at Gangavaram Port as a proper place for unloading imported goods and loading export goods, including empty containers and containerized goods. This amendment expands the existing customs area at Gangavaram Port, allowing for increased capacity and efficiency in import and export operations. The amendment is expected to contribute to trade facilitation efforts and support the growth of international trade through Gangavaram Port.

S.O. 2740(E).—Whereas Gangavaram Port has been notified as Customs Port by the Central Board of Excise and Customs under Section 7(1)(a) of the Customs Act, 1962, vide Notification No.: 85/2007(NT)-Customs, dated 21.08.2007 for the purposes of unloading of imported goods and the loading of export goods or any class of such goods. Further, the Central Board of Excise & Customs, New Delhi, vide Notification No.: 15/2002-Customs(NT), dated 07.03.2002 as amended by Notification No.: 78/2014-Customs(NT), dated 16.09.2014 issued under Section 4(1) of the Customs Act, 1962 included the area of Port of Gangavaram within the jurisdiction of the Principal Commissioner / Commissioner of Customs, Visakhapatnam. M/s Gangavaram Port Ltd. (GPL) has been approved to be Customs Area for the purpose of unloading of imported goods and the loading export goods or any class of such goods, in Berth No.: 1, Berth No.: 2, Berth No.: 3, Berth No.: 4 and Berth No.:5 vide this Office Notification No.: 01/2008- (CUSTOMS)(NT)(VSP), dated 16.10.2008 issued in F. No.: S10/13/2007-Prev and in Berth No.: 5, Berth No.: 6, Berth No.: 7, Berth No.: 8 and Berth No.: 9 vide this Office Notification No.: 03/2015-(CUSTOMS)(NT) (VSP), dated 14.07.2015 issued in F. No.: S10/13/2007-Prev (Part-II).

Now, in exercise of the powers conferred under Section 8(a) of the Customs Act, 1962 (52 of 1962), I, K. Engineer, Commissioner of Customs, Visakhapatnam, on the request of M/s Gangavaram Port Ltd. vide their letter ref No: GPL/M&CS/Customs/2022-23/281, dated 17.08.2022 hereby amend the Notification No.: 03/2015-(CUSTOMS)(NT)(VSP), dated 14.07.2015 by declaring Berth No.: 9 to be a proper place for unloading of imported goods and the loading of export goods or any class of such goods including empty containers and containerized goods.
