ICAI has requested CBDT to extend the due date of e‐filing of income‐tax returns, tax audit reports and report under section 92E of the Income‐tax Act, 1961

The efforts of the members in supporting the e‐initiative the Department requiring e‐filing of almost all audit reports under the Income‐tax Act, 1961 is appreciable. ICAI is aware of the numerous issues being faced by the members with regard to registration, frequent changes in utilities, uploading of balance sheet and profit and loss and so on. The Direct Taxes Committee of ICAI is taking up these issues with appropriate authorities from time to time. It has issued “Frequently Asked Questions” prepared in consultation with the officials of Directorate of Income tax (Systems) for the guidance of members. Inspite of these efforts, difficulties are being faced by the members in e‐filing the tax audit reports mainly due to continuous change in the utilities hosted on the CBDT website. Further, the difficulties being faced by the members and the assessees in Andhra Pradesh, Uttarakhand, Gujarat, Muzaffarnagar and other affected areas of Uttar Pradesh are also known to ICAI.

Considering the above factors, a request was extended to Chairperson, CBDT for extension of due date of filing income tax returns along with tax audit reports by one month from end of 30th September, 2013. ICAI has also sought extension of due date of furnishing the report under section 92E by one month from the end of 30th November, 2013 for AY 2013‐14.

Even though matter is being pursued on regular basis, it is desirable that the members complete their audits on or before 30th September, 2013 so that the assessees are able to file their income tax returns on time.

REPRESENTATION REGARDING CBDT Order F.No.225/117/2013/ITA II dated 26th September, 2013

The President and Council Members called upon the highest officials in the Central Board of Direct Taxes (CBDT) and have submitted representation pointing out practical difficulties being faced by the members in completing the tax audit. The frequent changes in the e-filing utility resulting in enormous loss of man hours have been pointed out. A detailed letter containing reasons justifying the extension has been submitted today, i.e., September 27, 2013. This is the THIRD REPRESENTATION made on the subject in this month itself.

While best possible efforts are being made, the members are advised to carry out the audit in accordance with the technical requirements prescribed by the Institute.

    TIME, OUR SO CALLED PRESIDENT AND ALL OF HIS CENTRAL COUNCIL MEMBERS SUOULD QUIT AS THEY MISERABLY FAILED TO WATCH THE INTERST OF THE CHARTERED ACCOUNTANTS. UNDER WHAT CONDITIONS AND UNDER WHAT STRESS WE WORKED OVERNIGHT TO FURNISH THE TAX AUDIT REOPORTS PHYSICALLY IS AN OPEN FACT. TO ADD TO MESERY THE E FILING WAS NOT WORKING IN OUR WESTERN PART OF RAJASTHAN SINCE 9.30 PM ON THE LAST DAY. IF OUR TOP BODY IS NOT ABLE TO CONVEY ITS RIGHT POINTS IT IS BETTER TO JOIN A TRANSPORT ASSOCIATION WHICH ALWAYS ACHIEVES WHAT IT DEMANDS ??

    Its really strange that inspite of so many repeated requests with so many genuine reasons why CBDT is taking so much time to take any positive decision regrading extension of return and audit report filing dates I think 15 days time will be sufficient to complete our work because our work starts from where the work of CA ends and when they are not able to complete the audit work how can anyone expect from the assessee to file his return of income by 30th Sep, 2013 when the assessee has to deposit tax online only and bank will function only one day i.e. on the last day of this month I don’t know how to make CBDT realize that the request for extension of filing of I.T. returns and Audit reports is must in the interest of justice without any loss of revenue.

    Why ICAI has requested the CBDT? It means the ICAI and its members are nor in a position to adjust to the rapid changes that is taking place in CBDT and I hope it is the right time that the CBDT and Finance Ministry should think of removing the 44AB audit for INDIVIDUAL AND PARTNERSHIP FIRMS.

    Appreciable efforts. Please follow up and update the positive outcome immediately. We are under great stress and the same is working adversely on health of ca fraternity which otherwise also is always under stress of various due dates.

    CBDT HAS TO CONSIDER THE REQUESTS OF THE CHARTERED ACCOUNTANTS PLEA, SINCE IT IS HIGHLY IMPOSSIBLE TO CONCLUDE THE AUDIT BY 30TH SEPTEMBER 2013 AND ADDED TO THAT SATURDAY IS HALF DAY WORKING FOR BANKS AND SUNDAY IS HOLIDAY AND MONDAY IS HALFERLY CLOSING DAY FOR BANKS. SO THE ASSESSEE CAN NOT PAY THE TAX WITHIN THE DUE DATE OF FILING OF INCOME TAX RETURNS.
    THE GOVERNMENT SHOULD NOT PRESSURISE THE PROFESSIONALS TO COMPLETE THE WORK IN A SHORT PERIOD OF TIME, WITH MANY AMENDMENTS TO THE FORMS BOTH ITR AND AUDIT REPORT FORMS.
    CBDT SHOULD EXTEND THE TIME, CONSIDERING OVERALL PRESSURE ON THE CHARTERED ACCOUNTANTS AND ALSO ON THE ASSESSEES, WHO WILL BE EAGER TO COMPLETE THE TAX WORK TO GET THE RELIEF FROM THE INCOME TAX RETURNS WORK. MOREOVER THE DEPARTMENT WILL NOT LOOSE ANYTHING IN THE FORM OF INCOME TAX, BECAUSE ALMOST 99% OF THE ASSESSEE WOULD HAVE ALREADY PAID THE TAX, EITHER BY ADVANCE TAX OR COVERED BY TDS. HENCE, THERE WILL NOT BE ANY LOSS TO THE GOVERNMENT EXCHEQUER BY EXTENDING THE TIME FOR FILING ITR TO 31ST OCTOBER 2013. A HUMBLE REQUEST TO EXTEND THE TIME.

    good efforts by the ICAI but the result should be effective and timely.
    As the normal life has been affected due to rain, road block, train cancelled, power failure and in that addition already the audit report utility and itr format late published .
    considering all these factors the CBDT must not delay in taking the decision.
    ALSO LOTS OF DELAY HAVE BEEN MADE .

    Dear Colleagues,

    We Appreciate the efforts of ICAI.

    However, department has not clarified anythng so far on their working on saturday and sunday. So, how we can submit manually reports ? So, its a trap only. Further, there is no meaning of announcement on the very last date as they usually do. They have insulted entire CA community like anything . The only remedy we have is to proove our work and wait till 2014 !!!

    THE MEMBERS OF THE ICAI ARE TOO INTELLIGENT AND MOST POWERFUL THAN THE POLITICAL PERSONS. SO PLEASE CARRY ON FOR EXTENSION OF DATE OF FILING

    I appreciate the move of ICAI for this issue as all the professionals are not able to complete their work by 30th Sep, 2013 and if they are not able to do so they will be directly answerable to the assessee who are not aware of all the problems being faced by us, so it is my humble request from ICAI to kindly ask the CBDT to extend the date of IT return filing as well as furnishing date of audit report and the decision should be taken immediately on Saturday itself so that we can work without pressure which will minimize the mistakes in filing the return of income

    Considering the lot of problems regarding audit, taxation, filling, we humbly request to exten to the Chairperson, CBDT for extension of due date of filing income tax returns along with tax audit reports by one month from end of 30th September, 2013. also sought extension of due date of furnishing the report under section 92E by one month from the end of 30th November, 2013 for AY 2013‐14.
