The Directorate General of Foreign Trade (DGFT), under Notification No. 03/2026-27 dated 2 April 2026, has amended the import policy for items under Chapter 71 of ITC (HS) 2022 with immediate effect. Several items including gold- and silver-related articles, platinum products, and precious metal goods have been shifted from “Free” to “Restricted” import status, subject to newly introduced Policy Condition No. 7. This condition exempts imports by Export Oriented Units (EOUs), Special Economic Zones (SEZs), and export-linked schemes, provided such goods are not diverted to the Domestic Tariff Area. The notification also imposes restrictions based on composition thresholds, such as platinum alloys containing more than 1% gold. Importantly, the benefit of transitional arrangements under the Foreign Trade Policy, 2023 has been expressly denied, making the restrictions applicable immediately regardless of prior contracts, letters of credit, or shipment status.

Subject: Amendment in Import Policy and Policy conditions of items covered under Chapter 71 of ITC (HS) 2022, Schedule-I (Import Policy)-reg.

S.O. 1732(E).In exercise of powers conferred by Section 3 and Section 5 of Foreign Trade (Development & Regulation) Act, 1992, read with paragraph 1.02 and 2.01 of the  Foreign Trade Policy, 2023, as amended from time to time, the Central Government hereby makes the following amendments under Chapter 71 of Schedule-1(Import Policy) of ITC (HS) 2022with immediate effect:

2. Policy Condition no. 07 of the Chapter 71 is introduced as under:

“ Imports by 100% Export Oriented Units and units located in Special Economic Zones (SEZs) shall not be subject to the above restrictions as per Para 6.01(d) of FTP, 2023 and under Rule 27 of the Special Economic Zones (SEZ) Rules, 2006 respectively, provided such imported goods are not sold into the Domestic Tarifff Area (DTAs). Further, imports under the schemes for export of Gems and Jewellery under Chapter-4 of FTP, 2023 shall also be exempt from these restrictions.”

2. Notwithstanding anything contained in Para 1.05(b) of the Foreign Trade Policy, 2023, (FTP) or any other provision, the benefit of transitional arrangements shall not apply to the restrictions imposed under this Notification.

3. The import policy as amended above shall come into force with immediate effect and shall apply irrespective of any prior contract, irrevocable letter of credit, advance payment, or shipment status.

Effect of the Notification: The Import Policy and Policy Condition of items as mentioned above covered under Chapter 71 of ITC HS, 2022, Schedule-I (Import Policy)is revised as mentioned above with immediate effect. These restrictions shall apply notwithstanding Para 1.05(b) of FTP 2023 and shall operate irrespective of any prior contract, irrevocable letter of credit, advance payment, shipment status, or any other commitment whatsoever. Accordingly, the benefit of transitional arrangements shall not be available.
