The expression “Plants, Fruits and Seeds (Regulation of Imports into India) Order, 1989 will be replaced by the expression “Plant Quarantine (Regulation of Imports into India) Order, 2003” in the ITC (HS) Classification of Export and Import items, 2004-2009.
In exercise of powers conferred under paragraph 2.4 of the Foreign Trade Policy, 2004-09, the Director General of Foreign Trade hereby makes the following amendments in the Appendix 28 of the Handbook of Procedures.
In the case of tea, all exporters who are required to submit Certificate of Origin (Non-Preferential) shall apply to the Tea Board or any Inspection Agency authorized by the Tea Board and enlisted in Appendix 35-B of the Handbook of Procedures, (Vol.I) with the documents listed above.
Import of all such edible/food products including tea, domestic sale and manufacture of which are governed by Prevention of Food Adulteration Act, 1954, shall be subject to all the conditions laid down in the aforesaid Act. Import of all these products will have to comply with the quality and packaging requirements as laid down in the Act. Compliance of these conditions is to be ensured before allowing customs clearance of the consignment.
In exercise of powers conferred under Paragraph 2.4 of the Foreign Trade Policy, 2004-09 and Paragraph 1.1 of the Handbook of procedures (Vol-I), the Director General of Foreign Trade hereby makes the following additions/ corrections/ amendments etc. in the Book titled “Schedule of DEPB rates.
Attention is invited to Para 2.46 of the Foreign Trade Policy regarding regularization of EO default and settlement of customs duty and interest through the Settlement Commission in the Central Board of Excise & Customs. It has been decided that the decisions of the Settlement Commission, in so far as customs duty and interest thereon are concerned, may be complied with by the Licensing Authority in cases of EO default under intimation to the Adjudicating Authority for regularization purposes.

In exercise of powers conferred under Paragraph 2.4 of the Foreign Trade Policy 2004-09, the Director General of Foreign Trade hereby makes the following amendment in Public Notice No. 9/2002-07 dated 30.04.2002 prescribing the procedure for import of certain items under the Indo-Nepal Treaty of Trade signed on 2.3.2002.
The licensing authority may also issue Advance licences, where SION are not fixed, based on self declaration and an undertaking by the applicant for a final adjustment as per Adhoc/SION fixed by ALC. However, no Advance Licence for import of horn, hoof and other organ of animal, pepper or the categories of agricultural items listed below or for any item for which DGFT may so notify, shall be issued under paragraph 4.7 by the licensing authority.
Attention is invited to Para 3.2 of Handbook of Procedures Vol.I 2004-09, wherein the last date for filing of application for grant of Star Status Certificate has been prescribed as 1st of March. A number of representations have been received in Hqrs as well as by Regional Licensing Authorities requesting for extending the last date for submission of such applications for obtaining the Status Certificate for the period 2004-05.
