Sub: Quarterly meetings by PCCIT for better co-ordination with PCsIT and Standing Counsels especially in matters pertaining to removal of defects in appeals filed before High Courts and minimizing of delay in filing of SLPs -reg.
Kindly refer to the above.
2. Non-removal/delay in removal of defects in pending appeals before the Hon’ble High Courts and delay in filing of SLPs in the Hon’ble Supreme Court is a matter of great concern for the Board. In many cases, Departmental appeals pending before High Courts have been dismissed due to delay in removing of defects as pointed out by the registry of the High Court. Similarly, Supreme Court has started taking serious view of the delay in filing of the SLPs. The Attorney General of India has expressed concern to the Hon’ble Finance Minster regarding enormous delay in filing of the SLPs.
3. Vide Instruction No. 6/2015, CIT(J) has been made the nodal officer, inter alia, for all matters relating to the jurisdictional High Courts as also for co-ordination with the counter parts of the other High Courts. It is felt that better co-ordination amongst CIT(J), PCsIT and Standing Counsels of the Department will go a long way in addressing the issues of delayed removal of defects in pending appeals with High Courts and delay in filing of SLPs.
4. It is therefore, requested that you may kindly hold quarterly meetings with the PCsIT, CIT (J) and Standing Counsels of your region to sort out and address any outstanding and potential issues with respect to removal of defects in pending appeals before High Courts and delay in filing of SLPs.
