Government of India, in response to a query in the Rajya Sabha on December 3, 2024, provided details regarding GST evasion cases in Gujarat. From FY 2021-22 to October 30, 2024, a total of 12,803 GST evasion cases were reported. Among these, three FIRs were registered under the Indian Penal Code (IPC) with eight individuals named. Of the 101 individuals arrested under the CGST Act, six remain at large. No involvement of government employees or officers in these evasion cases was reported. The government has yet to provide further specifics on any additional actions or developments in the cases.

Cases of GST evasion in Gujarat

Will the Minister of FINANCE be pleased to state:

(a) the number of cases of GST evasion reported in Gujarat during the last three years, till October 30, 2024;

(b) the number of such cases in which FIR was registered and the number of criminals identified in those FIRs;

(c) the number of criminals who have not yet been arrested among these criminals; and

(d) the number of Government employees and officers found guilty in the cases of evasion of GST?

STATEMENT REFERRED TO IN PARTS (A) TO (D) OF THE RAJYA SABHA STARRED QUESTION NO. *89 FOR ANSWER ON 03.12.2024 REGARDING “CASES OF GST EVASION IN GUJARAT” BY SHRI SHAKTISINH GOHIL.

(a) In the State of Gujarat, during Financial Year 2021-22 to 2024-25 (upto 31.10.2024), the number of GST evasion cases booked by Central Tax formations is 12,803.

(b) In such cases, 3 FIRs were filed under the IPC (now Bhartiya Nyaya Sanhita, 2023) and 8 persons were named in these FIRs. However, in the GST evasion cases as mentioned in part (a) above, 101 persons have been arrested under the provisions of Section 69 of the CGST Act, 2017.

(c) Amongst the persons named in the FIRs as mentioned in (b) above, 6 persons have not been arrested.

(d) In the cases mentioned in (a) above, no such involvement of government employee or officer has come to notice.
