Directorate General of Foreign Trade (DGFT), under the Ministry of Commerce & Industry, has issued Notification No. 58/2024-25, revising import policy conditions for vintage motor vehicles under Chapter 87 of ITC (HS) 2022. Previously, cars manufactured before January 1, 1950, were free for import by Actual Users, subject to compliance with the Central Motor Vehicles Act, 1988. The amendment now classifies vintage motor vehicles as per Rule 81A of the Central Motor Vehicles Rules, 1989, allowing their import under similar conditions. The revised policy ensures alignment with existing motor vehicle regulations, requiring compliance with Chapter 111A of the Central Motor Vehicles Rules, 1989, for imported vintage cars plying on public roads. This amendment takes immediate effect with the approval of the Minister of Commerce & Industry.

Subject: Amendment in Import Policy condition no. 1(III) under Chapter 87 of ITC (HS), 2022, Schedule —I (Import Policy). – reg.
S.O. 669(E): In exercise of powers conferred by Section 3 and Section 5 of Foreign Trade (Development &Regulation) Act, 1992, read with paragraph 1.02 and 2.01 of the Foreign Trade Policy, 2023, as amended from time to time, the Central Government hereby revises the Policy Condition no.1 (III) under Chapter 87 of the ITC (HS) 2022, Schedule-1 (import Policy) with immediate effect as under:-

(III) Cars manufactured prior to 1st January, 1950(111) are free for import by Actual Users. Policy Condition (I) and (II) above shall not be applicablelllA for these cars. Condition no. 1 (1) and 1 (11) of Chapter 87 of ITC HS 2022 shall not be applicable for these vehicles. However, such of the cars that would be plying on public roads will continue to be subject to Motor Vehicles Act, 1988 and rules made thereunder. Further, such imported cars shall comply with conditions laid down under Chapter 111A of Central Motor Vehicles Rules, 1989 as amended from time to time. |
Effect of the Notification: Classification of Vintage Motor Vehicles has been revised to align it with the Central Motor Vehicles Rules, 1989 as amended.
