Ronak Soni Son of Hariram soni Vs Union of India (Rajasthan High Court)

The accused person Mr. Ronak Soni while coming from Kolkata to Jaipur (via train) was intercepted by officials of DRI on 27.10.2022 and he was found carrying gold weighing 1872 grams of gold valued at Rs. approx 97 lacs. However, on the basis of confessional statements recorded u/s. 108 of the Customs Act he was arrested wherein past delivery of 625 grams was also added making the total quantity at 2500 grams and value thereof Rs. 1.37 crores and thus non-bailable offence.

It was argued by the petitioner that the case is falsely made-out, recovered quantity is less than Rs. 1.00 crore hence bailable offence. Granting Bail to the accused by the Hon’ble Court, it was observed that he is under custody since 27.10.2022, complaint has already been filed by the DRI, trial is likely to take time.
