The High Court, upon careful consideration, agreed with the appellant’s argument. It emphasized that while the mandatory nature of pre-deposit under Section 19 was acknowledged, the Commercial Court’s order to dismiss the proceedings for non-compliance was unwarranted. The Court highlighted the discretion vested in courts to impose conditions as necessary, including allowing pre-deposit in installments.
