Hindu Succession Act, 1956- The plea, of the appellants, that Rami Reddy’s family from the second wife and the testator’s family was a composite family and the properties were joint family properties of the plaintiffs and the defendants, has not been accepted by the trial court as well as High Court. We have no justifiable reason to take a different view on this aspect.

Procedure for making application for Registration of Geographical Indications

Every application shall be made in the prescribed forms and shall contain the following : A statement as to how the geographical indication serves to designate the goods as originating form the concerned territory in respect of specific quality, reputation or other characteristics. The three certified copies of class of goods to which the geographical indication relates. The geographical map of the territory. The particulars of the appearance of the geographical indication words or figurative elements or both; A statement containing such particulars of the producers of the concerned goods proposed to be initially resisted. Including a collective reference to all the producers of the goods in respect of which the application is made.

ICAI starts sending Admit Cards for November 2011 CA Examinations, Students can download online too

It is hereby informed that physical admit cards for the forthcoming November 2011 examinations have already been desptached by post. The admit cards with the photos and signatures of the candidates have also been hosted on www.icai.nic.in.

Addition of Certified Filing Centres (CFC) under MCA 21 e-governance Project

The Ministry of Corporate Affairs, on the request of the Professional Institutes, decided to re-open the registration process of CFCs and decided to allow enrollment of more CFCs so that the involvement of professional in XBRL filing and peak filing can be expanded to a large extent. The registration process is re-opened for a period of 2 months from October 1, 2011.

ICAI issues Instructions to examinees appearing in November, 2011 examinations

IMPORTANT NOTE: PCE (Professional Competence Examination) candidates should note the changed sequence of papers (as given in the time table printed on reverse of Admit Card) for November, 2011 examinations and that the examination for Group-I will commence on 2nd November,2011 and Group-II will commence on 06th November, 2011. Further all the IPCE UNIT candidates should check that their admit card is for the applicable Unit, otherwise they should inform the Institute in writing requesting for correction and should appear only in papers of respective Unit.

Last date for receipt of the comments on Exposure Draft of Guidance Note-Cost Accounting Standards(CAS-4) has been extended upto 31st October, 2011

The Institute has already released the revised Guidance Note on CAS-4 and requested for comments / suggestions on the same upto 10th October 2011. Based on the request of the members it has been decided to extend the last date for submission of the comments up to 31st October 2011. The Draft is available on the website of the Institute i.e. www.icwai.org.

100% FDI for new pharma ventures to continue

India will continue to allow 100% Foreign Direct Investment for new ventures in the pharma sector. The decision was taken at a high level meeting chaired by Prime Minister Dr Manmohan Singh to discuss the FDI policy in drugs and pharmaceutical sector held in New Delhi last night. An official release said, the move will facilitate addition of manufacturing capacities, technology acquisition and development of the pharma sector in the country.

Notifications should not allowed to be missile attacks on budding industries

Another caveat on legislative practices, particularly subordinate legislation and executive policy decisions and the decision making process, which is amenable to judicial review by courts is that, it is high time that subordinate legislations in the form of notifications issued by Executive should give the preamble, context, brief reasons and background and particularly defining their prospective a retrospective applications, should be adopted like statement of objects and reasons and memorandum explaining provisions are given with legislative Bills, so that the judicial review becomes an effective exercise and one liner amendments like the notification dated 28.04.2006 in the present case, which have far reaching consequences are not allowed to become missile attacks on the budding industries.
