In exercise of the powers conferred by sub-section (1B) of section 129A of the Customs Act, 1962 (52 of 1962), the Board hereby makes the following further amendments in the notification of Government of India, Ministry of Finance, Department of Revenue, No. 39/2005-Customs (N.T.), dated the 13th May, 2005, namely.

Commissioner of Customs, Chennai (Supreme Court)- The only question which arises for determination in this civil appeal is whether the adjudicating authority was entitled to load the royalty/licence fee payment on to the price of the imported goods, viz, the shuttle(s) by taking its peak price. In the present case, the importer/buyer used to negotiate with the foreign supplier on quarterly basis.
