NOTIFICATION

New Delhi, the 6th August, 2021

S.O. 3158 (E).––In exercise of the power conferred by sub-sections (3) and (5) of section 30 of the Tea Act, 1953 (29 of 1953), the Central Government hereby makes the following order further to amend the Tea (Distribution and Export) Control Order, 2005, namely:-

1. Short title and commencement. – (1) This Order may be called the Tea (Distribution and Export) Control (Amendment) Order, 2021.

(2) It shall come into force on the date of its publication in the Official Gazette.

2. In the Tea (Distribution and Export) Control Order, 2005, (hereinafter referred to as the principal order), for paragraph 4, the following shall be substituted, namely:-

“ 4. Application for business licence or permanent business licence. – Every distributor or exporter desiring to obtain a business licence and every exporter desiring to convert his business licence into a permanent business licence shall make an application before expiry of the validity of business license to the Licensing Authority in Form A”.

3. In the principal order, for sub-paragraph (1) of paragraph 12, the following shall be substituted, namely:-

“(1) Every business licence for an exporter shall be valid for five years from the date of its issue and each subsequent renewal, thereafter, shall be valid for five years from the date of its renewal on payment of fee as specified under Paragraph 17”.

4. In the principal order, in paragraph 14,-

(a) for sub-paragraph (1), the following shall be substituted, namely:-

“Every business licence shall be renewed on payment of fee as specified under paragraph 17 and the renewal certificate shall be granted by the Licensing Authority in Form K”;

(b) in sub-paragraph (3), the words “in Form J” shall be omitted.

5. In the principal order, for paragraph 17, the following shall be substituted, namely:-

“ 17. Fees- Every application for grant or renewal of business licence for exporters or distributors shall be accompanied by following fees, namely:-

For   exporters/conversion     of  business license into permanent licence Rs.2800/*
For distributors Rs.50500/-*
Certificate of origin Rs.100/-*

*exclusive of applicable taxes”.

6. In the principal order, for FORM-A the following shall be substituted, namely:-

“FORM A

7. In the principal order, FORM-B, shall be omitted.

8. In the principal order, FORM-J shall be omitted.
