Introduction: In a significant development, the National Company Law Tribunal (NCLT) Chandigarh has issued an order dated 03.02.2024, announcing the transfer of all pending cases from Bench 2 to Bench 1. This directive, passed under Rule 16(d), (e), and (f) of NCLT Rules 2016, mandates Bench No. 1 to conduct proceedings for cases previously under the jurisdiction of Bench No. 2 until further notice.

Detailed Analysis: The order reflects a procedural shift within NCLT Chandigarh, consolidating the adjudication responsibilities of Bench 2 into Bench 1. While Bench 2 members are directed to pronounce orders in reserved matters promptly, the broader implications of this transfer raise questions about case distribution, workload management, and the reasoning behind such a decision.

This move could be prompted by administrative considerations, workload distribution efficiency, or specific circumstances that necessitated the consolidation of proceedings. Understanding the criteria, decision-making process, and potential impact on the pace and efficiency of case resolutions requires a closer examination of NCLT’s internal dynamics and the factors leading to this consolidation.

Conclusion: The order to transfer cases from NCLT Chandigarh Bench 2 to Bench 1 marks a noteworthy development in the tribunal’s functioning. While administrative adjustments are common, the specific reasons behind this decision and its potential impact on the legal landscape in Chandigarh need further exploration. The legal community, litigants, and stakeholders will be keenly observing how this consolidation influences the expeditious resolution of pending cases and whether it introduces any procedural changes in the conduct of proceedings. As the transferred cases move to Bench 1, the efficiency and effectiveness of the NCLT Chandigarh’s adjudicatory process will be closely scrutinized in the coming months.
