The progressive measures, being undertaken by the Government in curbing corruption, have always been taken in positive spirit by honest and diligent members of ICAI, and as such the constitution of NFRA, will infact reinforce and reinstate the perception about the dignity and integrity of the noble profession of Chartered Accountancy. However, having said that, the Government must not be selective in its sincere endevours of curbing corruption, and as such the need of the hour is to constitute and create similar regulatory bodies (like NFRA) for Nationalised Banks, Bureaucracy, Political Parties, Taxation Authorities and even Medical, Legal and Companies Secretary Professions. Then only the Government’s Objective of “Sabka Saath Sabka Vikas, without any Discrimination” will be achieved and accomplished, in true spirit.
In the wake of the decision of the Bengaluru ITAT, in the case of “The ACIT, Circle-1(2)(1) Bengaluru vs. Shri Dilip Ranjrekar, in ITA No. 858/Bang/2016, dated 10.11.2017, an intriguing question has arisen, as to whether TDS is required to be deducted by the employer company, in the case of an erstwhile employee, who has otherwise rendered a continuous service of five years, on the interest amount earned by such employee, from the date of his cessation of employment, till the date of withdrawal of the accumulated provident fund balance.

We all seem to have the basic understanding of the Provident Fund Provisions. However, being a Fellow Member of the esteemed Institute of Chartered Accountants of India (ICAI), one question has always made me curious i.e. whether the provisions of EPFO Act are applicable to an autonomous regulatory body like ICAI.
Unfortunately, the raising of exorbitant and blatant ESI demands u/s 45A of ESI Act, 1948, under the disguise of non-co-operation from the factory or establishment, has become a routine and regular feature, now a days. As per provisions of section 45A of ESI Act, the ESIC authorities are empowered to determine the ESI Contributions, payable in respect of employees of any factory or establishment, based on the records available with them.
The month of February is usually associated with love, aspirations and valentine dates. For assessees and their tax consultants also, it do culminates into dates with assessing authorities, (i leave it up to you to think them to be valentine dates or not), as it is that part of the year, when the regular assessments get concluded and the statutory time-limit of 30 days in the demand notices also gets over and the assessing authorities start putting pressure for recovery of income tax demands…..
Revenue Authorities must review this existing stringent provision u/s 276B of the Income Tax Act and must consider doing appropriate modifications/changes in it so as to enable an effective action against the willful and habitual tax evaders only and not against the bonafide assessees who create wealth for the Nation.
