Due to the fact that most of the establishments are virtually closed on account of festivals of Durga Pooja, Navratra’s and Dussehra, representations were received from members all over the country posing the difficulties faced by them in preparing and filing the return of income by due date. Hence, ICAI has made a representation to the Chairman, CBDT requesting him to extend the due date for filing the return of income u/s 139 (1) of the Income Tax Act, 1961 suitably.
Further, ICAI has also suggested CBDT to request the Assessing Officers not to fix the cases near to the last date of filing return of income and where the cases are already fixed up the same may be adjourned to some later date. This request has been made since it has been noticed that a large number of cases have been fixed up by the Assessing Officers near to the last date of filing return of income which becomes burdensome for the assessees.

    IT WILL CERTAINLY BE HELPFUL TO ALL COMPANIES WHICH ARE
    STILL YET TO FILE IT RETURN FOR THE YEAR DUE TO PROBLEMS
    FACED BY THE COMPANIES FOR RETURN TO BE FILED ON DUE DATE THAT IS 30-09-2010, ATLEAST 10 TO 15 DAYS IT SHOULD BE EXTENDED FURTHER TO EASE THE THINGS OF FILING OF RETURNS FOR CORPORATES AND TAX AUDIT FIRMS ETC.

    Due to election, swinflu, navratri, vijayadashmi the due date for filing should be extended all over india. But CBDT has made unjustice by giving extention in three disticts of maharastra .

    As RBI declared holiday on 28th and 30th of septmber there will be no rtgs transcation on these days. hence even online tax payment is not possible on 30th sept. Hence there is a chance of extension of time limit by atleast 7 days.

    Though this time we are facing so many festivals but what I feel is that due dates are generally not for its further extention while everybody should plan in such a manner to accomodate the festival leaves etc.
    As far as the matter that the assessees are not at all concerned with this and they put responsibilites to their CA. Then they are sole resposible for the consequenses.

    First of all i must admit that I agree with the views expressed by Mr. Gautam Sanyal as the assessees are still looking for TDS certificates. In many cases Banks are issuing certificates in old format without mentioning the requisit details. Considering all other factors the reasonable EXTENSION of time must be considered by CBDT.

    Extension really required for filing Tax Returns u/s.139(1) from 30th Sept.09, as most of the assessees are not at all concerned about their responsibilities of Accounts/Tax Audit & all the tension they pass on the Chartered Accountants and Tax consultants.
