All India Motor Transport Congress Delhi has called  issued a Circular on 9th July 2018 to call Nationwide Strike of trucker and transporters against the GST Provisions related to Transporters especially related to E-Way Bill and Penalty for Not Properly and fully uploading of the E-Way Bill. Some other issues are constant increase in diesel prices, uncontrollable toll expenses, GST compliance issues etc.

Question also arises, Is there any Justification of 100% penalty for non-compliance of E-way Bill Rules?

Text of the Circular is as follows:-

” We are thankful to all members, trucker, transporter brethren and supporters to the movement for July 20th Nationwide Chakkajam leading to suspension of transportation services pan India to make the Government listen to legitimate issues of the Road Transport Sector of India.

Please find reference to the penalty imposed on M/s Gati Kintetsu Express Pvt. Ltd.  of Rs. 1,32,13,583/-by anti-evasion bureau for not updating part B of E-way Bill. Even the Madhya Pradesh High Court in W.P. no 12399 of 2018 M/s Gati Kintetsu Expres Pvt. Ltd. Vs Commissioner, Commercial Tax of M.P.  gave an order in favour of Madhya Pradesh Tax Department.

In the above context you are all requested use your judgment and discretion and do not take make only those bookings for which the delivery could be completed till July 19, 2018.

Due to imminent Indefinite Nationwide Chakkajam from July 20, 2018 onwards there are chances of getting entangled in E-way Bill issues because everything will come to a grinding halt from that day.

To avoid any pitfalls it is requested to all to inform your clients about the ground situation well in timers avoid any complications later On. “

    ITS A SAME FOR INDIAN SYSTEM. as you are imposing new system it should be warned for future not to panelty.

    Imposing huge penalty is not solution. If government/Department very Honest, then why still so many polluted vehicles are plying on the road.

    penalty is not A solution , but to find onwer of goods , WHY NOT SYSTEM DEVELOPED LIKE EACH & EVERY BILL OF SALE MUST HAVE E-WAY BILL UPLOAD IN PORTAL NO LIMIT OF VALUE

    Why not the Motor transporters help comply with the rule and discourage the corrupt business trying to avoid GST and engage in black marketeering. Transporters can afford to maintain a large fleet of trucks, so they can also maintain a clerk & a computer to comply with the Law. They are indirectly trying to support the business, who do not want to come under GST radar.

    While every salary earner is forced honestly declare his salary income and pay tax, why not the transporter help the government by encouraging the insisting on their clients to update the Part B and comply with the Law.

    This is the tax evading Indian mindset instituted by by years and years of corrupt governance & & officials of the previous regime turning a blind eye to corruption & black money generation in Business. India is with the honest PM and the ministry officials, who want to widen the tax base and avoid generation of corrupt & black money promoting mindset should be made accountable.
