The Finance (No. 2) Bill, 2024 introduces several significant amendments to the Customs Act, 1962 and the Customs Tariff Act, 1975. Key changes include updates to Section 28 DA, aligning proof of origin with trade agreements; a new proviso to Section 65, restricting certain manufacturing operations in warehouses; and modifications to Section 143AA and Section 157, broadening the scope to include other entities beyond importers and exporters. Additionally, Section 6 of the Customs Tariff Act, 1975 will be omitted, reflecting the dissolution of the Tariff Commission. Major tariff rate changes effective from July 24, 2024, include increased duties on PVC flex films, laboratory chemicals, and adjustments in rates for agricultural products and critical minerals. The amendments will also revise tariffs on consumer goods, chemicals, plastics, textiles, cancer drugs, and precious metals, aiming to realign rates with economic priorities and industry needs. These changes will be effective immediately upon the bill’s enactment, enhancing trade facilitation and sectoral regulation.

CUSTOMS

Note:

(a) “Basic Customs Duty (BCD)” means the customs duty levied under the Customs Act, 1962.

(b) “Agriculture Infrastructure and Development Cess (AIDC)” means a duty of customs that is levied under Section 124 of the Finance Act, 2021.

(c) “Road and Infrastructure Cess (RIC)” means an additional duty of customs that is levied under Section 111 of the Finance Act, 2018.

(d) “Health Cess” means a duty of customs that is levied under Section 141 of the Finance Act, 2020.

(e) “Social Welfare Surcharge (SWS)” means a duty of customs that is levied under Section 110 of the Finance Act, 2018.

(f) Clause Nos. in square brackets [ ] indicate the relevant clause of the Finance (No. 2) Bill, 2024.

(g) Amendments carried out through the Finance (No. 2) Bill, 2024, will come into effect on the date of its enactment, unless otherwise specified.

I. Amendments To the Customs Act, 1962

4. Clause (m) of subsection (2) of section 157 of the Customs Act is being amended by substituting the expression “a class of importers or exporters” with “a class of importers or exporters or any other persons” [103]

1. B. Amendment of Customs Tariff (Identification, Assessment and Collection of Countervailing Duty on Subsidized Articles and for Determination of Injury) Rules, 1995

The Customs Tariff (Identification, Assessment and Collection of Countervailing Duty on Subsidized Articles and for Determination of Injury) Rules, 1995 have been amended to insert a provision for New Shipper Review. This will be effective from 24.7.2024.
