Sub: Request to extend the due date of filing Income-tax returns for assessees mentioned under clause (a) of Explanation 2 to Section 139(1) and Tax Audit report u/s 44AB for the AY 2017-18 from 31st October, 2017 to 30th November, 2017
At the outset, we thank you for accepting our suggestion for extending the ‘due-date’ for filing Income Tax Returns and various reports of audit from 30th September, 2017 to 31st October, 2017 vide our representation No. ICAI/DTC/2017-18/Rep-24, dated 29.8.2017 (copy attached). The said extension was made so as to allow sufficient time to the assessees’ and tax professionals, who are required to make first time compliances in view of the fact that the Goods and Services Tax (‘GST’) has come into effect on 1-7-2017.
In this regard, we wish to inform you that members and assessees are still grappling with the complexities of first time GST compliance and the first time compliances required to be made due to implementation of Income Computation and Disclosure Standards (ICDSs) as stated below:
1. First time GST compliance :
The various compliances which are required to be made in the months of October and November due to the newly enacted GST law are given in the following table:

Further, as per press release dated 6th October, 2017 the last date for filing the FORM GSTR-4 return under composition scheme for the quarter July-September, 2017 has been extended to 15.11.2017. Also, the last date for filing the return in FORM GSTR-6 return by an input service distributor for the months of July, August and September, 2017 has been extended to 15.11.2017.
The filing of such GST returns is being done for the first time. The GST law is new and hardly any lime has been given after enactment to absorb, assimilate and implement the new law, it is consuming a lot of time of the members in comprehending and ensuring compliance with the new law. Also, the technology issues has resulted in loss of innumerable man hours of assesses and professionals impacting all other work.
2. First time reporting requirements due to applicability of newly notified Income Computation and Disclosure Standards (ICDSs).
The amended From No 3CD has substituted sub-clause (d) of clause 13 with new sub-clauses (d), (e) and (f) requiring reporting of the adjustments and disclosures mandated as per the newly notified Income Computation and Disclosure Standards (ICDSs). In addition to this, reporting the net effect on the income due to application of ICDS has to be done for the first time in the ITR forms notified tor the AY 2017-18 under ‘Schedule ICDS – Effect of Income Computation Disclosure Standards on profit’.
As the reporting in respect of ICDS in Form No. 3CD and ITR Forms is being done for the first time, there are lot of nuances or the new reporting requirements imposed due to implementation of ICDSs. As a result, members and assessees require some more time for the said reporting.
In view of the above, our members are voicing their apprehensions regarding the limitations of time available for conducting tax audit and filing Returns of Income by October 31, 2017 for AY 2017-18.
Suggestion:
Institute believes that the members of the profession have to continuously maintain and strive to enhance the standard of services provided by them, which includes the quality of audit conducted by them. Conducting the tax audit in an effective manner is therefore necessary to ensure that there is no loss to the Revenue. In view of above and our earlier submissions made vide the attached representation, it is once again requested that the last date of completion of tax audit and filing of tax audit report and income-tax returns, which has been extended to October 31, 2017 may be further extended to November 30, 2017.

We are getting doubt whether we are in Democratic Country or not. So much pressure and the govt is not announcing the date of extension so far
I thank to ICAI for extension of due date of Tax Audit because the month October was engaged in the festivals from 17.10.2017 to 27.10.2017. And during festivals there is no chance to work. And rest of time was engaged in filing of GST return. So the date of Tax Audit should be extended up to 30th. November, 2017.

we are facing the worst position here right now in all types of taxation work. Why they are acting like that they are unaware of the situations right now. Every tax professional is busy right now in compliance of GST. From the month of July-17 no other works had been accurately. why they want to collect the revenue only by penalties not by the taxes.
And how helpless feeling we are. We are just depend on what they will say or not. I am feeling sometimes we are back in era of a cruel KING and his innocent people

WHAT IS DUE DATE ? IT SHOULD A DATE CONVENIENT TO ALL TAX PROFESSIONAL TO PERFORM THEIR DUTIES EFFICIENTLY AND TO COMPLY WITH ALL LEGAL REQUIREMENT. IT IS NOT MR. JAITLEY’S OR OTHERS BIRTHDAY THAT CAN NIT BE ALTERED. BASED ON PRESENT SITUATION TIME TAKING FACTORS FOR COMPLYING THE REPORT DATE SHOULD BE DETERMINED. GOVT SHOULD UNDERSTAND THE PROBLEM FACING BY THE TAX PROFESS AND DATE SHOULD BE RE-SCHEDULED.
Due date of filing Tax audit and income tax should be extended in view of the Festive holidays during Oct,17 and GST compliances. Government is not listening to the plight of tax payers and professional who are restless thereby affecting the health of professionals. Multiple compliances of tax laws makes life miserable and over burden. Is it the simple tax compliance ? Traders & professionals only wants some more time as a relief. The adamant government must listen the woos of professionals enabling them to do quality work and help the Gov’t in increase the revenue.

The Due Date should be extended till 31st. December, 2017 because all practitioners are engaged to work in GST, they are suffering from depression with heavy Late Fee. So I thank to ICAI for requesting for extension of Due Date of Tax Audit.

Day by day all the statutory compliance are being shifted from government to Dealers / Assessees to Chartered Accountants / Tax Consultants, making the life of the service providers ( CA’s and Tax Consultants) a restless. We professionals are really working hard, under pressure and stress. Government should understand it is humanly not possible to comply so many mandates at a time. October month is heavely scheduled with GST returns, Income Tax audits and returns, TDS returns, ESI and EPF returns. During October it is a totally 10 holidays ( 5 sundays, 3 Diwali Festival, 2nd Gandhi Jayanthi, 14 & 28th Bank Holiday) In the nutshell, we have leftout with 20 working days to complete so many !!!!!!. Apart from this, there was a heavy rain almost 7-8 days during October 2017 throughout the country. so finally, we have been left with 13 working days to complete the task.

4 Days to go and the extension of Tax Audit Due Date not declared yet so I think the late decision will take more life of CA.
Thank for, to The Finance Minister has weaved off the Late Fee of Filing GSTR 3(b) for the month of July, Aug & Sept, but which return has been submitted for the month of Aug before announcement of weave off late fee, the return has been submitted with late fee, it should be remove the late fee from submitted return.Because the small dealers can’t be adjusted the late fee amount.

sir that much whole country is requesting but still they not considering our request just thinking any value for professional is there or not. dear friends please help in this regards that i know due to my health i not going to file about 50 to 60 audits within due date , suppose if not if 271b initiated what to do to drop please advice in this regards so that i can take some rest on my health ground since due to sleepness i got fever shivering becuase of tension please. they became deaf ears for this much request that too from whole country

On 23rd The ICAI President had made a request to Arun Jaitley for extension of time for Tax audits upto 30th Nov. Today already 27th Oct. Instead of saying yes or no for the request, the CBDT is sending messages like “Most urgent, file your Tax audits returns by 31st oct, donot wait till last minute.” They want to create pressure from the assesses to the auditors. I am very much regretful and repenting why we have given opurtunity to such criminal minded people to rule us.
I appreciate the efforts of ICAI in requesting for extention of due date of tax audit. The CA fraternity are reeling under severe pressure and having sleepless nights to ensure compliance. If extention is announced early i.e today itself, we can move on to file GST2. Not getting sleep, as GST 2, if not filed in time, clients will loose ITC and end up getting tax liabilities while filing GST3. Govt should earnestly consider our request for extention, as we the CA fraternity are tirelessly shouldering the Govt in achieving its goal of revenue mobilisation and enforcing the compliance of various tax laws enacted by it.
Very genuine request for extension of tax audit, This time due to implementation of GST Law, most of the accountants are engaged in GST compliance and have yet not produced records for audit. As 26 October is over, so request to FM, CBDT for timely extension of due date otherwise the quality of audit work will be very poor due to heavy work presure.

Very genuine request. A big salute to the president of ICAI for requesting extension of Tax Audit due date. Hope CBDT will grant at least one more month extension. Reasons are genuine.
