Notice from Customs for recovery of Drawback on Non-Realisation of Exports Proceeds

1. Exporters get the benefits of Duty Drawback on value of exports sales made, this drawback is processed by the department after the goods are shipped irrespective of foreign exchange realized or not.

2. However, realization of foreign exchange is important condition for entitlement of drawback.

3. Linking of FIRC/BRC with the shipping bill ensures the realization of foreign exchange.

4. W.e.f. 01-04-2014, monitoring of realization of export proceeds is required to be done online through the RBI-BRC Module and no manual BRCs/ Negative statements will be accepted.

We received a notice for recovery of Duty Draw Back on short realization of Exports proceeds. Short realization is only on account of Bank Charges deducted by foreign Bank and is even less than 2% of Proceeds. I understand previously they allowed dedction upto 12.50% of proceeds. Please convey if this notice is valid for recovery on account of Bank Charges by Foreign Bank.

What we can do with gov. banks ?
We have no hold on bank. We had submitted all documents againd foreign currancy received in our account , but bank office don’t update it on EDPMS system. In some cases bank officer ask we haven’t your export docunets even we have letter with bank sign and stamp to subitted same docunets to bank. Every six month the banks officere changed. Government BABUs don’t lproper respons to us. Now what we can do ?

    1. CA Sachin M Jain says:

Mr. Hasmukh Patel Ji, you (including every Exporter) will have to ensure all the foreign remittance are updated by the Bank in the EDPMS system of RBI. Details updated by the Banks are transmitted to Customs Department, unlike previously submitting the BRCs manually. Now no need to submit the BRCs to the Customs port. However, there are some practical challenge in this process too, due to which details are not flowing properly and ultimately an Exporter may get Notice from the Customs Department for non-realization.
If your bank don’t updated details on regular basis then better change the bank else you will have to face the heat quite often.
