Let’s start with the basic definition of Layoff which is common in most of the countries, i.e., Temporary suspension or interruption of working hours of an employee for a statutory layoff period, caused due to external factors like recession, loss in business, pandemic etc, apart from that, the employer has the right to summon the employee back to work at any moment before the statutory period expires and contractual relationship remains intact.

Industrial Dispute Act is enacted in year 1947 by the parliament of India in order to make the provisions for the investigation and settlement of industrial disputes, and for certain other purposes. A contractual employee is defined under Section 2(b) of The Contract Labor (Regulation and Abolition) Act, 1970 which states that a contractual employee is employed by a principal employer in connection with the work of an establishment through a contractor.
