Tran 1 due date extended. Time limit for submitting declaration in FORM GST TRAN-1 under rule 117 of Central Goods and Service Tax Rules, 2017 is extended till 27th December, 2017.

Subject: Extension of time limit for submitting the declaration in FORM GST TRAN-1 under rule 117 of the Central Goods and Service Tax Rules, 2017

In exercise of the powers conferred by rule 117 of the Central Goods and Services Tax Rules, 2017 read with section 168 of the Central Goods and Services Tax Act, 2017, on the recommendations of the Council, and in supersession of Order No. 07/2017-GST dated 28th October, 2017, except as respects things done or omitted to be done before such supersession, the period for submitting the declaration in FORM GST TRAN-1 is extended till 27th December, 2017.

    All registered persons under GST who want to avail credit by filing TRANS 1 be provided one more opportunity to file TRANS 1. Small traders had to face lot of hardship under GST regime, unless Govt supports it will be very difficult.

    It is difficult to understand what Government is gaining by not allowing users to file revised Trans 1 inspite of knowing their system glitches. The Government is thus encouraging malpractices to follow instead of allowing tax payers to file their return and show transparency.

    The petitioner seeks a writ of mandamus directing the GST council
    respondent no.2 to make recommendations to the State Government to
    extend the time period for filing of GST Tran-1 in the case of the
    petitioner because his application was not entertained on the last date
    i.e. 27.12.2017 and he has filed his complete application for the
    necessary transactional credit.
    The petitioner has alleged in the petition that despite making several
    efforts on the last date for filing of the application, the electronic system
    of the respondent no.2 did not respond, as a result of which the petitioner
    is likely to suffer loss of the credit that it is entitled to by passage of time.
    It is the petitioner’s case that he has also submitted his application for
    transitional credit manually on 10.1.2018. The respondents were served
    with a notice on 19.1.2018 with a copy of the petition and they have also
    obtained instructions today. They say that portal is likely to be opened
    but is unable to say that when the portal is likely to be opened.
    In view of the above, the respondents are directed to reopen the portal
    within two weeks from today. In the event they do not do so, they will
    entertain the application of the petitioner manually and pass orders on it
    after due verification of the credits as claimed by the petitioner. They will
    also ensure that the petitioner is allowed to pay its taxes on the regular
    electronic system also which is being maintained for use of the credit
    likely to be considered for the petitioner.
    With the aforesaid directions, the the writ petition shall stand disposed of
    finally.

    Request to tax guru management,

    on behalf of the tax guru site users. kindly make a representation to GST council and urge them to extend the trans 1 date so that common citizens are not effected. if this does not happen lot small enterprises will have to close there ventures.

    Request for possible solution who have have missed to avail the tax credit through trans 1. it is almost going to be one and half month. there has been no solution from govt side.

    tran 1 to be extended as most are in mood of festive n new year mood. Adding to this server is also not supporting. Pl extend another 30 days.

    sir, we have submitted the trans 1 form but missed filing due to problem with system. please provide us is there any way to get the cen vat credits

    Please extending the GSTTRAN-1 to 31.03.2018
    Because our sales tax return Now we are revised due to sum internal Issue.
    Please i am requesting to Govt Please extend the due date of TRAN-1

    We are trying to fill Tran 1 return on 27dec 2017& on that day the site was very slow and when we upload it they always show error
    I think we can upload it on next day I.e(28-12-2017) b’cos some sites are also mention last date of filling Tran1 is 31-12-2017
    But from the next day to till today I.e(29-01-2018) it is saying we are not allowed to file return and saying not available

    It is humble request to our Government pls reopen Tran1
    B’cos there are many like me which are facing this problem

    We had tried to file Trans-1 on or before 27th December 2017 but due to technical error time to time at the time of submitting the Trans-1 form and website congestion we could not file Trans-1.

    There was a message also for extension of date for filing Trans 1 up to 31st December 2017.

    Request to respective authority to open the portal so that we may able to file Trans-1

    we have sucessfully filed tran1 but when we are going to file gstr3b for the month of dec 2017 it showing you have submitted tran1 but nof filed we sent screen shots to gst help desk of filed tran 1 but when now we are checking status of tran 1 it is showing submitted status . we are unbale to understand how this problem will be solved
