Video conferencing facilities can be used in all matters including remands, bail applications and in civil and criminal trials where a witness is located intrastate, interstate, or overseas.
Guideline number 1.4 of video conferencing guidelines issued by the High Court on July 7, 2018. is as follows:-
Video conferencing facilities can be used in all matters including remands, bail applications and in civil and criminal trials where a witness is located intrastate, interstate, or overseas. However, these guidelines will not apply to proceedings under section 164 of Cr.P.C.
FULL TEXT OF THE HIGH COURT ORDER /JUDGEMENT
With the consent of the parties, we have heard the petitioner and learned counsel for the respondents through video conferencing (Webex App software).
This petition by way of public interest litigation has been filed by the petitioner, a practicing Advocate, seeking following of the video conferencing guidelines issued by this Court specifically guideline No. 1.4 issued on 07.07.2018.
Having heard the petitioner, the petition is disposed of by directing the respondents to examine the issue and thereafter, if necessary, or in case some instance of violation is found, to take necessary action and steps.
