Penalty under excise rule 26 can be imposed only on natural individual person

This appeal is filed against order-in-original passed by the Commissioner whereby the learned Commissioner imposed a penalty of Rs.4,80,000/-under Rule 26 of the Central Excise Rules on the appellant. The penalty was imposed on the ground that the appellant has received invoices from M/s. Ambe Vaishno Steels Pvt. Ltd. However, they have not received the inputs covered under the invoice. Accordingly, the penalty under Rule 26 was imposed.
