NOTIFICATION
New Delhi, the 1st September, 2016

S.O. 2835(E).— In exercise of the powers conferred by clause (b) of sub-section (1) of section 3 read with clause (i) of sub­section (1) of section 4 and clause (b) of sub-section (1) of section 5 of the Minimum Wages Act, 1948 (11 of 1948), the Central Government after consulting the Advisory Board hereby makes a draft proposal to revise the rates of wages as specified in the Table as mentioned hereinafter in the draft proposal for fixing the minimum piece-rate wages and minimum guaranteed time-rate wages per day for employee engaged in the stone mines in the whole of India and in supersession of the notification of the Government of India, in the Ministry of Labour and Employment, published in the Gazette of India, Extraordinary, Part II, Section 3, Sub-section (ii), vide number S.O. 278 (E), dated the 3rd March, 2006, except as respects things done or omitted to be done before such supersession and notice is hereby given to all persons likely to be affected thereby that the said draft proposal shall be taken into consideration after expiry of two months from the date on which copies of this notification, as published in the Official Gazette, are made available to the public.

Any objection or suggestion, which may be received from any person or organisation with respect to the said draft proposal within the time frame stipulated above, will be considered by the Central Government.

The objections and suggestions shall be addressed to the Secretary, Ministry of Labour and Employment, Shram Shakti Bhawan, Rafi Marg, New Delhi-110001.

Draft Proposal

The revised minimum piece-rate wages and minimum guaranteed time-rate wages shall consist of basic rage of wages as set out in column (3) of the Table annexed to this draft notification, payable to the classes of employees engaged in the work mentioned against them in column (2) thereof, and a special allowance [ hereinafter referred to as Variable Dearness Allowance (VDA)] at the rate set out in column (4) of the said Table for minimum piece rate of wages. The Variable Dearness Allowance shall be adjusted by the Chief Labour Commissioner (Central) at an interval of every six months commencing on the 1st October and 1st April of every year on the basis of the average Consumer Price Index Number for Industrial Workers (Base 2001=100) for the preceding period of six months ending on the 30th June and the 31st December every year respectively, at the rate of and in the manner specified in the column (4) of the Table.
