PAN Card – CBDT Playing hide and seek game with tax payers

CBDT again played hide and seek game with the tax payers like the one it played in Sep-Oct 2013 with regard to extension of due date for filling of ITR and TARs.

CBDT has issued two notifications,  First on 23rd Dec 2013 requiring addittional proof of Date of Birth along with Proof of Identity (POI) and Proof of Address (POA).  Second Notification was issued on 16th January notifying revised procedure which required self attested documents and TIN_FCs and PAN Centers to verify those documents from originals. With  press release dated 30.01.2014 it has kept in abeyance the second notification i.e. Documents are no more required to be self attested or originals required to be presented before TIN_Fcs, PAN Centers, but the operation of First Notification has not been stayed, put on hold, meaning thereby from 03rd February each applicant has to produce proof of DOB alongwith POI and POA.

Earlier I had raised concerns about the availablility of DOB Proof in case of persons above the age of 50 and millions of Male and Female illiterates vide my post titled “ PAN Card Notification ignores Practical issues in Implementation” .

In the notification dated 23.12.2013 the alternate proof of DOB is an affidavit duly sworn in by the applicant and attested by a Judicial Magistrate. It is going to be uphill task to get those affidavits attested from the Magistrates keeping in mind the heavy rush of work before Hon’ble Courts. It is certainly going to be a costly affair also for it would require assistance of an Advocate to get those affidavits attested.

I request all CBDT Members to look out and make the provision which are feasible and tax payer friendly, not those which creates confusion and harassment to tax payers.
