CBDT extends date only in Punjab, Haryana, UT of Chandigarh and Gujarat

After Punjab & Haryana High Court the Gujarat High Court also directs CBDT to extend the due date for Filing of ITR to October 31st in its Judgement today.

The case was argued by Saurabh Soparkar.

    CHARTERED INSTITUTE ALWAYS WANT TO INTERFERE IN OTHER DOMAIN SUCH AS NAME CHANGE OF ICWAI. SECTION 14A AND 14AA EXCLUSIVE DOMAIN OF COST ACCOUNTANT ONLY. WHY CA’S ARE ENTERED THERE ?     Nowadays Chartered Accountants (CA) in India are mostly workings as brokers of Tax officials and Bankers. Almost all CA’s are simply selling their signature to business community busy in negotiating with tax officials and bank officials and they can sign any balance sheet blindly. CA’s work as middlemen between loan seekers and bankers and they can manipulate the entire accounts picture and get handsome amounts as fees .

    If by giving tax audits to CMA’s means that cost audit too must be opened up then financial audits too should open up for all.

    CA’s have all wrong conception that all audits can be done only by them…..VAT , Service tax, Excise , Internal audit and now IBA recommended stock and concurrent audit for CMA’s too…

    The CA institute plays politics….the name change of the cost institute was opposed by ICAI-CA…..it seems CHARTERED ACCOUNTNTS ARE FRIGHTENED OF COST ACCOUNTANTS…

    cost account CMA, CS , LLB , ETC. all this courses must be cancelled and only one courses should be there for all financial services i.e CA . person who will pass CA exam should only be authorized to do all work. ( DONE DONE FINAL IT )

    This Govt talks of ease of business but is behaving in an dictatorial and brash manner. Due to the delay on their part, work got delayed earlier and they do not even have the courtesy to give some time for completion of the rest of the work. Despite many people going to Courts and making this very logical and fair request, the Govt is indulging in plain ‘dadagiri’. This has offended a large number of assessees and professionals too. Very timid behaviour on the part of this Govt.

    It is time CBDT gracefully accepts the courts decisions and extends the due date for both filing of return of tax audit cases and filing of tax audit reports.

    I think it is only in india CA’s allowed to work in the field of Accounting, Audit and Taxation, which CA’s made it monopoly and used to protect only their interest and manipulations without considering national interest, ordinary people and their requirement. If Cost Accountant are included in the definition of ‘ Accountant ’ under the income Tax Act ordinary people and corporate world would get best professional services at competitive prices.

    Now a day’s Tax Audit is just required a stamp of CA nothing more. In my view allowing these two (CA’s & CMA’S ) under the definition of Accountant will create an enhance quality & competitions. Then only general masses will be benefitted with the quality and standard of performance at competitive prices.

      I and almost all my CA friends have been working till late night since August 2015 (Including Sundays and Holidays). Now it is 11.18 P.M and I am still in my office, though the date for filing the returns have been extended. Still you will say that we are here to just put our rubber stamps?

    As Tax Audit matters the institute of Chartered Accountants of india demands that CA’s are very much expertise in Taxation, Accounts & law matters compare to other professionals. But Sir , those days are gone , at present CMA’s is very much capable and have good knowledge in Accounts, Taxation,& law matters rather than CA’s.The clients should have the right to choose the right auditor that may be CA’s, or CMA’s

    Thanks to the petitioners who have moved Writs in Punjab H.C and Guajrat H.C and perused the case inspite of professional commitments. I am also thankful to the judges of these courts in taking bold decision. I am, also surprise why Hon’ble Delhi High Court did not gave bold decision. The present judgments are big blow on CBDT which fails to understand the problem of Tax professionals and their staff who are working very
    heard and have not even taken any break. The govt. fails to understand the mental pressure on the professionals and due to various changes, it is really impossible to complete the work.

    TAX AUDIT IS NOT A ROCKET SCIENCE SO WHY NOT COST ACCOUNTANT (CMA) ARE CONDUCT TAX AUDIT RELATED MATTER ? TAX AUDIT WAS INTRODUCED IN THE YEAR 1984 U/S. 44AB OF THE INCOME TAX ACT WHICH IS MADE ONLY BY A CHARTERED ACCOUNTANT. FROM THAT YEAR MONOPOLY AND CORRUPTION WAS STARTED . IF GOVT.     It is very much argent to change the Accountant Definition under income tax act 1961 and to include CMA’s & CS under accountant definition and stopped the monopoly of Chartered community. In Europe, America, Canada Govt. authorize many profession institute to conduct audit .So why not in India other professional such as CMA’s & CS’s are authorize to conduct Tax audit ? Monopoly of one institute is always dangerous for the country so it is the right time for the Govt. to include CMA’s & CS’s under Accountant definition of income tax act 1961.

      Dear Sir, Please know the entire matter before commenting about other Professionals. It was not incapability of CAs to conduct the Audit in time but Incapability of CBDT for timely notifying the Income Tax Returns. For your kind information the Income Tax Returns are notified as late as 6th and 8th August. Till that time no schema of business Return was available for uploading Return. Also on 24th Sept again Tax Audit Schema was changed. Thus it has left less than 2 months in the Hands of CAs to comply as against 6 months given by the Act. Though few High Court has rejected the Extension demand but all High courts have directed the CBDT that from next FY, all forms should be notified on or before 1st April.Expecting fair comments about other professionals from a professional person like you.

        And for your kind information, Many CAs including me have completed their audits. But we are fighting against Arrogance of Govt Officials and injustice caused to Tax Payers. It will be Tax payers who will be made to pay penalty of Rs 1.50 Lacs and not CAs who are going to pay penalty, still CAs are fighting for justice.

    demand for extension is totally unreasonable. We professional are poor people which leave their work for last minutes . Why people not able to get their accounts finalized even after Six month from the close of the financial year. Very strange. Govt should go to the Supreme Court against the orders of the courts for not extending the due date. Then only we professional and our clients can only maintain discplain

    Gujrat HC & Punjab & Hariyana HC has rightly delivered the justice to CAs & tax professionals. This is a tight slap on the face of CBDT, FM and their adamant behavior. It was very meritorious case and the extension was just reasonable demand.Its hightime, all the tax professionals should unite and keep fighting with this evil and notorious acts of cbdt to treat the professionals as bonded labours and not hear their reasonable cry and pains.       CBDT should notify the date extension at the earliest it is a matter of real concern as only few hours left for 30 sep if it is not notified till tomorrow then situation will be dubious .High Court order should prevail and should be binding on CBDT

    I am not a C A.
    I am an ordinary citizen of this nation helping my son to maintain his books of accounts who falls under Tax Audit.

    It is really painful that our adamant Government is not listening to most learned and talented peoples’ reasonable request for extension of date by 15 days or a month for filing Tax Returns and Audit Reports. As a results they are entailed to knock the doors of judiciary.

    Chartered Accountants and Tax Consultants are the extended arms of nation’s financial treasure who act as a guiding star for taxpayers and help the Government to streamline the inflow of revenue.

    I feel, instead of sue motto extending the date the Government officials have made this a prestige issue.

    at least in future the reasonable and rational demands be handled by them with due sensitivity.

    CBDT has dont Know ? Which tax return is most important ? Tax Audit or without tax Audit ? They can extend due date of filling ITR without tax audit for next one month and again for next 7 days of sep 15. Then why they not extending the date of Tax Audit Report and ITR form. They are working for benefit of Public ? or for themself ? CBDT acting as a small baby who dont know what he is doing ? right or wrong.CBDT acted only by seating and All C A and Tax consultant acting as a practically in the market they are the facing problem and not CBDT ?     Irrespective of outcome about extension of due date for filing of return and tax audit report, I must congratulate all those who carried the matter to High Court and fought the same.

    I am still not sure whether, CBDT will extend it for whole of the country.

    Needless to say, CBDT has option to approach SC against order of Hc of P&H and Gujarat.

    Punjab and Haryana and Gujarat HC have ordered CBDT to extend the due date,

    I am still not sure whether, CBDT will extend it for whole of the country.

    There is a possibility that, it will extend it only for those respective states.

    Rajasthan and Karnataka HC have declined to go into the issue being a policy matter and domain of Government. They have directed the Government to take into consideration the submissions of petitioner.

    Ofcourse, direction does not mean an order.

    Delhi has specifically denied extension. But it has not ordered that, CBDT can not extend it.

    Don’t say that the audits will go to CMAs or CS. They are not trained in accounts and audit as ICAI does. First think yourself high and if the Government does, then it is for the Government paying way for making witchery to itself. First of all the CA Act 1949 is enacted under an act of Parliament and ICAI is a statutory autonomous body like CBDT and we are no way lesser than that of CBDT. We must join together and represent through our Institute to amend section 44AB to file the audit report along with Return of Income so that every year all CAs and Assessee’s need not worry about the dates and to represent to CBDT for extension of time. Even this move will improve the quality of audit report. The aim of the Tax Audit Report is to make an easy assessment by the Tax Authorities. The due date is not at all required since without filing returns the AO cannot do any assessment on the basis of TAR. The assessee is having time upto completion of that Assessment Year to file his returns without any penalty. Hence this 44AB due date should be scrapped. This is used only to threaten the assessee’s and our elected people representatives (many of may be businessman) never bother about this. The only community bothering about the assesseee is only CAs.

      CMA’s r quite capable for all kinds of audits….CA institute has played politics to keep it out of most things….it interfered to stop its name change to ICMAI….cma ‘s do vat ,excise,service tax,internal audit,IBA has recommended stock and concurrent audit for banks….seems ICAI -CA is frightened of ICAI-CMA

    government needlessly converted non-issue into issue because in any case it was getting interest for delayed payment and it was not at loss. Besides, by one stroke , Arun Jaitely’s threat to rope in CWAS /CS has helped this government lose its ” ease of Business’ image ‘ in a big way

      Mumbai High Court Decision
      Judges pointed that once one HC rules under Article 226, same would be binding on all HC in country.
      If CBDT don’t reply by tommorrow, they will hear it today i.e. at 3.00pm 30/09/15

    It is time to get cost accountants for tax audit too.Politics of the CA institute has kept it out .Now its amply clear that the CA’s can’t handle this alone —they cannot keep out other professionals and at the same time not be able to do the work themselves.
    The standing committee of parliament has too recommended CMA and CS for tax audit …the DTC bill got scrapped …very surprisingly.

      1.You can rename your institute but never acquire the quality of ICAI member .

        if opening tax audit means opening cost audits too then financial or statutory audit too should be opened up for all…..the name change of icwai to icmai was opposed by icai-ca…they have ben poking their nose since 1959 into icwa matters……the quality of CA pass outs has gone done drastically…..it is not as good as it was before the year 2000….

      Its not that CAs can’t handle tax audits. It is the question of quality of audit. Do you remember MCA extending date for furnishing cost audit reports ? so seeking extension doesn’t show incapacity. Further do you really think CWA syllabus covers entire income tax at the depth of CA final ?

      I want to say something that in India audit will be done by CAs only. If you or any person want to do audit, nobody stopped you. You simply has to get register with ICAI and pass few exams that are conducted by ICAI and start auditing.       44AB Reads as ” get his accounts of such previous year audited by an accountant before the specified date and furnish by that date the report of such audit in the prescribed form duly signed and verified by such accountant and setting forth such particulars as may be prescribed.
      this is very clear that the audit report shall be furnished by the specified date which in the instant case is extended to 31.10.2015.

    This is the victory of Public Demand in Public Interest, at this moment I haven’t closed the eyes since last 79 hrs. and the CBDT People are still Sleeping behind the Fake Circular which got routed in the name of Govt. Of. India, Govt. is celebrating the digitalization thing but before celebrating something get round up around the culprits of the Fake Circular. and last but not least It was a shameful attitude of the CBDT Authority to not hear the voice of public demand.

    Thanks to the Judiciary to get involved into the matter for which the Govt. Officials could have easily solved out with negotiation with representation of various CA’s. and Tax Consultant society and association, But here I would like to also write that in the hole matter where gone the tax payers for whom we ware fighting. there was not a single representation by any trade unions or traders association or business unions.

    What CBDT will do now in next two days. it must issue notification in time so that the same has some meaning otherwise once the TAR are filed there is no point in issuing notification or going to supreme court

    CBDT DECIDED TO GO TO SUPREME COURT AGAINST THE ORDER OF PUNJAB & HARYANA HIGH COURT OF EXTENDING THE DATE OF FILING OF INCOME TAX RETURN (AUDIT).
