No. ICAI/Advsry-RC-Br/May’22 23rd May, 2022

To

The Chairmen of all Regional Councils and Branches of ICAI

Sub: Representation to the government and other authorities

It has been observed that Regional Councils/Branches are representing directly to the various government authorities like Directorate of General of Police to issue a memorandum, on Standard Operating Procedures, to be observed and to be followed by police or any other authority, while making an arrest of Chartered Accountants without intimating to Head Office.

In this context, the Council at its 411th meeting held on 19th and 20th May, 2022 discussed the recent arrest of Chartered Accountants and other instances of ill-treatment of CAs and decided to constitute a Group comprising of its members to interface with authorities in order to ensure that just and fair treatment is meted out to Chartered Accountants and they are not made soft targets.

With this instant communication it is advised that the Regional and Branches comply with the directions issued vide letter No. 17/RBA/Dir/2011-12/1 dated 15th April, 2011 and mail from rba@icai.in dated 20th September, 2017 respectively, and all representations or any request such type of matters must be compulsorily referred to the ICAI, New Delhi for taking up the matter centrally with the concerned Government Department/authority. We are also inviting your attention on advisory dated 11th February, 2021 copy enclosed.

Further, the name, platform and resources of regional council, branch or Institute should not be used for staging any protest or dharna. It is requested that in case where it is felt that a matter requires to be represented for enlisting their support in the furtherance of the professional interest of the members then the same be sent to the ICAI at secretary@icai.in; councilaffairs@icai.in; rba@icai.in. This would ensure uniformity as well as consistency in the ICAI’s efforts for the interest of the members and students.

Compliance of the above may be ensured.

With kind regards,

CA. (Dr.) Jai Kumar Batra
Secretary, ICAI
