CBIC announced an amendment to the Deferred Payment of Import Duty Rules, 2016 vide Notifications No. 58/2023-Customs (N.T.), Dated: 3rd August, 2023. Known as the Deferred Payment of Import Duty (Amendment) Rules, 2023, it signifies an important shift in import regulations.

Analysis: The amendment brings two significant changes to the 2016 rules. Firstly, it provides the Central Government the power, under exceptional circumstances, to allow payment on a different due date if deemed necessary and expedient. This introduces a degree of flexibility that can accommodate unusual circumstances.

Secondly, it allows eligible importers to make deferred payments if they have paid the duty for a bill of entry within the due date and also paid the differential duty along with the interest for reassessment within one day, excluding holidays. This change potentially affects the cash flow of eligible importers and could introduce more complexity in managing duty payments.
