Muthiah Lakshmanan Vs ITO (ITAT Chennai)

The appeal before the Income Tax Appellate Tribunal (ITAT), Chennai, concerned the assessment of Muthiah Lakshmanan for the Assessment Year (AY) 2011-12. The core issue stemmed from an ex-parte assessment order passed by the Assessing Officer (AO) under Section 144 of the Income Tax Act, 1961, following a reopening notice under Section 148. Crucially, the assessee had failed to file a return of income or cooperate during the assessment and initial appeal stages.

Background and Additions

The assessment was completed on December 27, 2018, as an ex-parte best judgment assessment due to a complete lack of compliance from the assessee. The AO made two significant additions to the assessee’s total income:

1. Income from Speculation: Based on NMS (Non-filers Monitoring System) data related to commodity exchange transactions, the AO estimated speculative income. The addition was calculated as 0.25% of the colossal transaction value of ₹307,03,19,200/- on the grounds that no details were furnished by the assessee to substantiate his income or losses.

2. Unexplained Investment: A sum of ₹38,88,500/- was added to the total income under Section 69A of the Act, representing cash deposits that the assessee failed to explain.

Aggrieved by the resulting tax demand of ₹68,45,990/-, the assessee filed an appeal before the Commissioner of Income Tax (Appeals) (CIT(A)), National Faceless Appeal Centre (NFAC), Delhi. However, the appeal was subsequently dismissed by the CIT(A) on November 19, 2024, again due to a lack of compliance, as noted in the appellate order.
