India Imposes Anti-Dumping Duty of USD 460–681/MT on Chinese Titanium Dioxide for Five Years

Summary: The Ministry of Finance (Department of Revenue), through Notification No. 26/2026-Customs (ADD), dated 24 October 2026, has imposed anti-dumping duty ranging from USD 460 to USD 681 per metric tonne (MT) on specified imports of Titanium Dioxide originating in or exported from China PR. The duty has been imposed under Section 9A(1) and (5) of the Customs Tariff Act, 1975, read with Rules 18 and 20 of the Customs Tariff (Identification, Assessment and Collection of Anti-dumping Duty on Dumped Articles and for Determination of Injury) Rules, 1995. The notification follows the Directorate General of Trade Remedies’ (DGTR) final findings dated 3 August 2026, issued in remand proceedings pursuant to the Calcutta High Court’s judgment dated 22 September 2025 in Indian Paint Association v. Union of India & Ors. (WPO No. 148 of 2025). The designated authority concluded that Chinese Titanium Dioxide was being exported to India at dumped prices, with significant dumping margins above the de minimis threshold, causing material injury and threatening further injury to the domestic industry. It also established a causal relationship between dumped imports and the injury suffered by Indian manufacturers.

The anti-dumping duty applies to Titanium Dioxide covered by tariff items 2823 00 10, 3206 11 10 and 3206 11 90, subject to specified product exclusions. The notification prescribes producer-specific rates of USD 609/MT for Anhui Gold Star group entities, USD 563/MT for Shandong Jinhai and Shandong Xianghai entities, and USD 460/MT for specified LB Group entities. A rate of USD 510/MT applies to twelve identified non-sampled cooperative producers, while USD 681/MT applies to the specified residual categories, including certain imports routed through third countries. The notification clarifies that customs tariff classification is indicative and that the actual product description determines duty applicability.

Importantly, eligibility for individual producer-specific rates is conditional upon submission of a valid commercial invoice containing a dated and signed declaration identifying the manufacturer, product quantity and country of manufacture. Where the prescribed declaration is not furnished, the duty applicable to other producers will apply. The notification excludes specified Titanium Dioxide products used in food additives, pharmaceutical tablet coatings, skincare products, certain textile and fibre applications, décor paper production and nano or ultrafine Titanium Dioxide having particle size below 100 nanometres. However, Titanium Dioxide used as a pigment for printing on textiles, garments or fabrics is not covered by the textile exclusion.

The anti-dumping duty will remain effective for five years from the date of publication in the Official Gazette, unless revoked, superseded or amended earlier, and must be paid in Indian currency. The applicable exchange rate will be determined under Section 14 of the Customs Act, 1962, with reference to the date of presentation of the bill of entry under Section 46. The measure will increase the import duty burden on covered Chinese Titanium Dioxide, particularly for importers sourcing from producers subject to the higher residual rate. Importers should verify product specifications, manufacturer identity, country of origin, applicable duty category and prescribed invoice declarations before customs clearance to ensure correct assessment and avoid disputes.
