Asian Paints Limited Vs DCIT (ITAT Mumbai)
ITAT Remands Asian Paints’ Section 35(2AB) R&D Deduction for Fresh Examination; Section 50 Fiction Does Not Bar Set-Off of Long-Term Capital Loss; Foreign Tax Credit Claim Based on Later Certificates Must Be Verified; CSR Donations Eligible for Section 80G Despite Section 37 Disallowance: ITAT Mumbai.
Summary: The Mumbai Bench of the Income Tax Appellate Tribunal considered a consolidated group of cross-appeals filed by Asian Paints Limited and the Revenue for Assessment Years 2016-17, 2017-18 and 2018-19. The appeals arose from scrutiny assessments under section 143(3) and separate appellate orders passed by the NFAC. Since most grounds involved recurring issues and substantially identical facts, the Tribunal first examined the appeal for AY 2016-17 and applied its findings mutatis mutandis to the later years, except where a distinct issue required separate adjudication. The assessee was engaged in manufacturing, selling and distributing paints, coatings, home-décor products and bath fittings, besides providing related services. The disputes covered weighted deduction for in-house scientific research, expenditure on distribution of gift articles, disallowance under section 14A and Rule 8D, adjustment of book profit under section 115JB, provision for doubtful debts, evaluation of business opportunities, prior-period expenditure, trip schemes for dealers, Colour Idea Stores, post-invoice incentives and discounts, old balances written off, set-off of capital loss, foreign tax credit and deduction under section 80G for eligible donations forming part of CSR expenditure. The Tribunal ultimately held that the assessee’s and Revenue’s appeals were partly allowed for statistical purposes.
