The Government of West Bengal by notification dt. November 19, 2024 (#LABR/562/23099/17/2023(LITECEIC), has extended the jurisdiction, both territorial as well as subject matter jurisdiction, of the Industrial Tribunals, Labour Courts, Employees’ Compensation Court and the Employees’ Insurance Court.

As per the notification the Hon’ble Governor of the West Bengal empowered all the presiding officers (including the Judges-in-Charge) of the Industrial Tribunals, Labour Courts, Employees’ Compensation Court, Employees’ Insurance Court for adjudication disputes/cases under following enactments:

  • Industrial Disputes Act, 1947
  • Employees’ Compensation Act, 1923
  • Payment of Wages Act, 1936
  • The Minimum Wages Act, 1948
  • Employee’s State Insurance Act, 1948.

The Governor empowered the respective authorities for distribution and transfer of the pending cases and other cases filed on regular basis among Tribunals / Courts under their jurisdiction for its quick disposal.

NOTIFICATION

Whereas the Government of West Bengal is implementing various Labour laws for Welfare and Social Security of the workers and their family. The laws provide for adjudication of industrial disputes/cases to remove the causes of friction between the employer and worker in day-to-day working of the establishment; to promote measures for securing amity and good relations between them maintaining peace and harmony in the industrial sector for fast industrial growth; to provide Social Security for Welfare of the workers and their family.

And whereas these Labour laws empower the State Government to constitute Industrial Tribunals, Labour Courts, Employees’ Compensation Court, Employees’ Insurance Court and appoint presiding Officers/Commissioners and Authorities for adjudicating disputes/cases under relevant Labour laws.

And whereas it was under active consideration of the State Government to ensure justice to the workers by providing easy access thereto and quick disposal of the cases.

And whereas the Government of West Bengal has decided to extend the jurisdiction (territorial as well as subject matter) of the Judges/ presiding officers (including the Judges-in-Charge) of Industrial Tribunals, Labour Courts, Employees’ Compensation Court, Employees’ Insurance Court.

Now, therefore, in exercise of the power conferred by clause ( c) Sub-Section (1B) of Section 10, of the Industrial Disputes Act, 1947 (14 of 1947) (hereinafter referred to as the said Act ) read with Sub-Section (2) of Section 2A as subsequently amended, and in partial modification of Notification No. Labr/62/ Dte (I. Trib) dated 22.08.2016 and in supersession of all other previous notifications issued by this Department in this regard, the Governor is hereby pleased to empower the all presiding officers (including the Judges-in-Charge) of Industrial Tribunals, Labour Courts, Employees’ Compensation Court, Employees’ Insurance Court for adjudication disputes/cases under following:

i) Industrial Disputes Act, 1947;

ii) Employees’ Compensation Act, 1923;

iii) Payment of Wages Act, 1936;

iv) The Minimum Wages Act, 1948;

v) Employee’s State Insurance Act, 1948.

The Governor is also pleased to empower the all-presiding officers (including the Judges-in-Charge) of Industrial Tribunals, Labour Courts, Employees’ Compensation Court, Employees’ Insurance Court while acting as in-charge of another Industrial Tribunal/ Labour Courts/ Employees’ Compensation Court/ Employees’ Insurance Court on additional duty for adjudication disputes/cases of the said tribunal and court.

The Governor is further pleased to empower Heads of Directorate/Judge-in-Charge of Industrial Tribunals, Employees’ Compensation Court, W.B. and Employees’ Insurance Court, W.B. for distributing the pending cases and other cases filed on regular basis among Tribunals /Courts under their control for quick disposal of such cases and transferring the pending cases and other cases filed on regular basis, if required, for adjudication and quick disposal of such cases to other Directorates through this Department in the public interest. This Department itself may allot any specific and additional work, and distribute the cases among the Industrial Tribunals, Employees’ Compensation Courts and Employees’ Insurance Court, if necessary, in the public interest from time to time.

This notification shall come into force with immediate effect.
