Dear friends, after the publication of my earlier article related to Form CSR-1 with the heading Mandatory Registration of NGO with MCA for Getting CSR Funding, I receive lot of queries related to due date of filing of Form CSR-1 and availability of Form CSR-1 on MCA Portal. Please note that, as per guidelines issued by MCA there is no due date specified for filing of Form CSR-1 with MCA but from 01.04.2021 CSR Funding will be released only to that NGOs, that are registered with MCA by filing Form CSR-1.

So, if you want CSR Funding then it is mandatory for you to get registered with MCA by Filing Form CSR-1 as soon as possible. And Form CSR-1 is now live for Filing on MCA Portal.

Following type of NGO’s are eligible to file Form CSR-1 on MCA Portal for getting CSR Funding

(a) a company established under section 8 of the Act, or a registered public trust or a registered society, registered under section 12A and 80 G of the Income Tax Act, 1961 (43 of 1961), established by the company, either singly or along with any other company, or

(b) a company established under section 8 of the Act or a registered trust or a registered society, established by the Central Government or State Government; or

(c) any entity established under an Act of Parliament or a State legislature; or

(d) a company established under section 8 of the Act, or a registered public trust or a registered society, registered under section 12A and 80G of the Income Tax Act, 1961, and having an established track record of at least three years in undertaking similar activities

Note: One more query raised by NGOs is that, whether they can directly file Form CSR-1 with MCA. To remove there doubts please note that, Form CSR-1 is to be signed digitally by the authorised person of NGO and a practising professional. The Professional may be Chartered Accountant/ Company Secretary/ Cost Accountant who is in whole time practising, so NGOs cannot directly file Form CSR-1, they have to approach the professional for filing Form CSR-1.

Following documents are required for filing Form CSR-1

1. Copy of PAN Card of the NGO

2. Mail ID and Mobile Number

3. Details of Governing Body Members

4. Copy of Registration Certificate

5. Digital Signature of the Authorised Person with his PAN Number

      For getting registered under CSR-1, your NGO must have registered under Section 12 And 80G of Income Tax Act, 1961. If your NGO is registered under these section, you are eligible to register under Form CSR-1

        what if a public charitable Trust has applied for 80G (just now in the end of Apr’21) and is yet to get the 80G certificate? Can the Trust still go ahead and register with MCA CSR Form1 with “applied for 80G” status?

          You must have valid registration U/s 80G and Section 12A on the date of Filing Form CSR-1. Just filing of 80G Registration application does not solve the issue. You must be registered under Section 80G and 12A.
