Abidbhai Umarbhai Qureshi Vs ITO (ITAT Ahmedabad)

The case of Abidbhai Umarbhai Qureshi vs. ITO was decided by the ITAT Ahmedabad, where the assessee appealed against the order of the Commissioner of Income Tax (Appeals) (CITA), which had upheld certain additions made by the Assessing Officer (AO). The appeal concerned two main issues: the disallowance of cash payments of ₹31.65 lakh under Section 40A(3) of the Income Tax Act, and the disallowance of ₹11.25 lakh in transportation expenses due to the registration date of the vehicle. The assessee contested these additions, arguing non-compliance with regulations and incorrect verification by the AO. Additionally, the assessee claimed a lack of understanding of the income tax procedures, given their illiteracy and involvement in the livestock trade.

The ITAT found that while the assessee had failed to attend hearings and comply with notices from both the AO and CIT(A), no prejudice was caused to the Revenue. The ITAT noted that the procedural defaults could be rectified with proper compliance if the assessee were given another chance. Given the lack of prejudice to the Revenue, the Tribunal remanded the case for a de novo assessment under Sections 144 and 147, with directions for thorough verification of the contested issues. This remand was issued with the intention of providing the assessee an opportunity to comply with the assessment process properly. The appeal was allowed for statistical purposes, and the case was sent back to the AO for further examination and adjudication.
