Summary: The Gujarat High Court partly allowed Tax Appeal Nos.1691 and 1692 of 2008 arising from search proceedings under Section 132 of the Income Tax Act, 1961. The search was conducted on 20th September 2001 in the Bright Group cases, following which the assessee disclosed undisclosed income and disputes arose concerning investment in his residential house, unexplained cash receipts and FDRs. The Assessing Officer valued the house investment at Rs.1 crore and made additions including Rs.44.20 lakh towards undisclosed investment, Rs.26.21 lakh towards unexplained cash and Rs.3,82,567 towards FDRs. The CIT(A) reduced the house-related addition to Rs.22.10 lakh, granted telescoping benefit between the house investment and unexplained cash addition, and restricted the FDR addition to Rs.82,567. The Tribunal subsequently determined the house investment at Rs.85 lakh, sustained the Rs.26.21 lakh cash addition, rejected telescoping and sustained the Rs.82,567 FDR addition. The High Court held that telescoping was not justified because the assessee failed to establish a time-period link between the house investment and unaccounted cash. However, it found the Tribunal’s Rs.85 lakh valuation arbitrary and accepted Rs.70 lakh as the house value, resulting in an unexplained investment addition of Rs.23,19,308. The Court also reduced the FDR addition to Rs.40,665, being the investment value rather than maturity value, granting relief of Rs.41,902. The Rs.26.21 lakh unexplained cash addition was sustained.
