Sales Tax Bar Association (Regd.) Vs Union of India (Delhi High Court)

Delhi High Court directs Sales Tax Bar Association (STBA) to formulate suggestions for improving the GSTN system, which, according to him, is creating impediments in smooth administration of the Central Goods and Services Tax Act, 2017 and the Delhi Goods and Services Tax Act, 2017.

FULL TEXT OF THE JUDGMENT/ORDER OF DELHI HIGH COURT

1. Pursuant to the orders passed by a coordinate bench of this Court on 28.09.2018 and 04.04.2022, status reports have been prepared on behalf of respondents no.2 and 6, as also on behalf of respondents no.3, 5 and 7. 1.1. Counsels appearing for the said respondents say that they have furnished copies of the status reports to the counsel for the petitioners.

1.2. These status reports will be filed before the next date of hearing, so that they are placed in the Court record, as well.

2. In the meanwhile, Mr Puneet Agarwal, who appears on behalf of the petitioners, will formulate suggestions for improving the system, which, according to him, is creating impediments in the smooth administration of the Central Goods and Services Tax Act, 2017 and the Delhi Goods and Services Tax Act, 2017.

2.1. The suggestions will be put to Mr Harpreet Singh, who appears on behalf of respondents no. 3, 5 and 7 and Mr Aman Naqvi, who appears on behalf of respondents no. 2 and 6.

2.2. Mr Singh will indicate to Mr Agarwal, as to whether or not the suggestions made by him are viable and are capable of being incorporated.

3. In this exercise, Infosys, which has installed the GSTN portal and is also responsible for maintaining it, will also be involved. The concerned representative of Infosys will participate in the meetings convened with Mr Agarwal, Mr Singh and Mr Naqvi.

3.1. To be noted, Infosys is represented by Mr Bagaria, senior advocate with Mr Debnath.

4. We may also note that the other technical team is represented by Tech Mahindra.

4.1. This team is represented by Ms Ambika Mathur, Advocate. The concerned representative of Tech Mahindra shall also participate in the deliberations held for removing the glitches in the existing system.

5. We are told that the status reports have been filed by both Infosys, as well as Tech Mahindra.

5.1. We would exhort, as indicated above, the technical teams of both Infosys and Tech Mahindra, to also, participate in the meetings.

6. Accordingly, list the matter on 26.09.2022.
