Tax Consultants Society, Coimbatore has forwarded a memorandum dated 30.11.2018 to Union Finance Minister for extension of time For Filing Annual Return In Form GSTR 9 And Audit Report In Form GSTR 9C till 31st March 2019. Text of the same is as follows-

SUB: MEMORANDUM/REPRESENTATION ON EXTENSION OF TIME FOR FILING ANNUAL RETURN IN FORM GSTR 9 AND AUDIT REPORT IN FORM GSTR 9C.

Greetings. Tax Consultants Society is a ten year old association of tax practitioners and consultants with around 450 active members, registered under Societies Act in the year 2008.  This association is formed with motto to serve the consultants by updating their knowledge both in direct and indirect tax matters by conducting monthly study circle meeting and seminars on various topics in VAT/Excise/Service tax (now GST) and in Income tax by inviting speakers with professionally enriched in the subject matter that included Centre and State Government officials.

This particular representation is to request the Hon’ble Union Finance Minister requesting for extension of due date for filing the GST Annual Returns for various types of assessees. We have written to your good selves many a times regarding various issues including web portal issue faced by the trading community in compliance both direct and indirect matters and got possible solutions from you and also CBIC and CBDT and GST council.

GST is a new concept and the new GST annual return and audit report is designed in a such a way that even the consultants and chartered accountants are not able to fill the accurate details in the column provided for as it is either auto populated or space is provided to fill manually.  It requires reconciliation with reference to GSTR1, 3B and 2A and other refund filed.  It is a difficult task to complete and time is short as the tool is not enabled yet to file online.  For companies with all India turnover require more reconciliation state wise..The  extension of filing of Annual Forms GSTR-9, 9A, 9B and 9C is the need of the hour for the trading community as the reconciliation with connected monthly returns would take much time for each assessee.

It is pertinent to note that in addition to filing of annual return for the period July 17 to March 18 under GST provisions, each state Government has prescribed an annual return (in Tamilnadu it is Form WW) for the non-GST period, viz, April 17 to June 17 based on the annual turnover. Therefore, the entire pressure is now shifted to the GST practitioners/consultants to prepare two annual returns for one financial year within 31st December 2018.

We therefore request your goodself to make suitable order to extend the time of filing the annual returns under GST Act to 31st March 2019 and consider our request for the welfare of the trading community and to the GST practitioners.
