REX Registration in India: Process, Documents, Rules of Origin & Benefits

Summary: The Registered Exporter System (REX) is a self-certification mechanism under which eligible registered exporters can make a prescribed Statement on Origin on commercial documents for qualifying exports under applicable preferential arrangements. For Indian exporters, REX is particularly associated with the EU Generalised System of Preferences (EU-GSP), under which exporters with a REX number can self-certify the origin of eligible goods. Step 1: Identify the product and correct HS/ITC-HS classification.

Step 2: Verify whether REX is applicable for the proposed destination and preferential scheme.

Step 3: Examine the applicable Rules of Origin and determine whether the exported product qualifies as originating.

Step 4: Prepare the REX application and supporting documents.

Step 5: Submit the application to the appropriate Local User/competent registration authority.

Step 6: Respond to any clarification or additional-document requirement raised by the authority.

Step 7: Upon successful verification, obtain the REX Registration Number.

Step 8: Use the REX number and prescribed Statement on Origin for eligible export consignments in accordance with the applicable rules.

Benefits of REX Registration

REX can provide several practical benefits to eligible exporters, including self-certification of preferential origin, simplified export documentation and reduced dependence on obtaining individual origin certificates for qualifying shipments.

Where the applicable preferential scheme provides reduced customs duties and the product satisfies the prescribed origin requirements, the overseas importer may be able to claim the corresponding preferential tariff treatment.

Important: Rules of Origin

REX registration is not merely a registration certificate. Exporters making a Statement on Origin are responsible for ensuring that their products satisfy the applicable preferential Rules of Origin.

Businesses should therefore maintain appropriate records relating to manufacturing, raw materials, imported components, suppliers, invoices and origin calculations.

Under the REX framework, exporters are required to maintain appropriate commercial accounting records and evidence concerning materials used in qualifying goods. The DGFT framework also provides for post-verification of self-certified origin declarations by competent authorities.

Ongoing Compliance After REX Registration

REX compliance does not end when the registration number is issued. Exporters using the self-certification facility should maintain the documents and records necessary to substantiate the preferential origin claimed in each Statement on Origin.

DGFT’s EU-GSP REX guidance and FAQs also prescribe controls over exporters using the self-certification system. Exporters are required to respond to verification requests within the prescribed time, and non-compliance can have consequences for the REX registration.

The competent Local Authorities may undertake post-verification of self-certified origin based on requests from importers or customs authorities of the importing country.

Accordingly, exporters should ensure that the origin claimed in each Statement on Origin can be substantiated from their manufacturing, procurement, supplier and accounting records.
