The Ministry of Commerce and Industry has issued a draft notification (G.S.R. 498(E)) dated 13th August 2024, proposing amendments to the Static and Mobile Pressure Vessels (Unfired) Rules, 2016, under the Explosives Act, 1884. These draft rules, which aim to update and clarify various provisions, will be considered by the Central Government after 30 days from their publication in the Official Gazette. The key amendments include the introduction of a new fee structure for inspections, testing, and certification of pressure vessels by inspectors, competent persons, or Third Party Inspection Agencies (TPIAs) under specific rules. The new fee schedule covers various activities, such as stage-wise inspections, design drawing appraisals, safety valve testing, periodic vessel testing, and the issuance of safety certificates for premises and transport vehicles. Interested parties may submit their objections or suggestions regarding these draft rules to the Deputy Secretary (Explosives) within the specified period. The amendments are intended to ensure that the inspection and certification processes are adequately funded and to provide clarity on the costs associated with compliance under the updated rules. The notification also references previous amendments to these rules made in 2018, 2019, and 2021.

New Delhi, the 13th August, 2024

G.S.R. 498(E) —The draft of the following rules further to amend the Static and Mobile Pressure Vessels (Unfired) Rules, 2016 which the Central Government proposes to make in exercise of the powers conferred by section 5 and 7 of the Explosives Act, 1884 (4 of 1884), is hereby published as required by sub-section (I) of section 18 of the said Act for information of all persons likely to be affected thereby; and notice is hereby given that the said draft rules shall be taken into consideration after thirty (30) days from the date on which the copies of this notification as published in the Official Gazette are made available to the public;

Objections or suggestions, if any, to these draft rules may be sent to the Deputy Secretary (Explosives), Department for Promotion of Industry and Internal Trade, Ministry of Commerce and Industry, Room No. 204, Vanijya Bhavan, New Delhi – 110001 or Email: [email protected]; within the period specified above;

The objections or suggestions which may be received from any person with respect to the said draft rules, within the period so specified will be considered by the Central Government.

Draft Rules

  1. Short title and commencement-

(1) these rules may be called the Static and Mobile Pressure Vessels (Unfired) (Amendment) Rules 2024.

(2) They shall come into force on the date of their publication in the Official Gazette.

3. In the Schedule -I after table B, following table shall be inserted namely;

C, Fees payable to Inspector or Competent Person or Third Party Inspection Agency (TPIA) for inspection, testing and certification under rules 13, 18, 19, 33 & 43 shall be as follows:-

iii) Premises covered under Table 6 & 7 of Rule 22 1000
iii) Premises covered under Table 4 & 5 of Rule 22 5000
7 Certificate of safety for transport vehicle under rule 43 2000

Note : The principal rules were published in the Gazette of India, Extraordinary, Part-II, Section 3, Sub-section (i) vide notification G.S.R. 1109(E), dated the 1st December, 2016 and subsequently amended vide G.S.R 388(E), dated the 20th April, 2018, G.S.R 148(E), dated the 25th February, 2019 and G.S.R. 609(E) dated 31/08/2021.
